If your child receives services through the school district do you know what "rights" as parents we have if any?

Apparently in my district which has 5 elementary schools (yet only one middle school and high school) they can send your child to another elementary school then what you are zoned for, for certain services.


I have my meeting in a couple weeks.

I am pretty sure they will be suggesting a 15:1 ratio with my DS getting his own aid. From what I hear this most likely means he will be going to a different school them my DD goes to currently. I was told I could request for her to move there but she will be going into second grade next year and I don't think its fair. But I also don't want kids in 2 different schools so I rather my son go where she goes and get his services there. I want them to be together but also my aftercare arrangements will not work if they are at different schools (also won't work if they both get moved to this new school)

Obviously, I am going to ask that he gets sent to where my DD goes but if they say no is there anything I can do about it?

Unfortunately this is legal. It sucks though!

My friend had this issue with her twins years ago. Son with special needs was moving to another school since his school didn't have the class he needed (15:1:1). She submitted a request to allow her general education daughter to go to that school also, and they denied it. This was Middle Country. Ultimately she put her son in a gen. ed class so they could be together.

*I* also went through the school changing. My son went to the same school until it came time for 3rd grade. They move all the kids out of that school for 3rd, then bring them back for 4th. I said no way! Put him in gen. ed with resource room. Didn't work out, since the teacher was just a witch. We ultimately moved in the middle of that school year to another district.

Thank you for the response. This sucks. I won't move my DD she would be really upset and again I don't think its fair to her.

I am nervous enough for DS to be going to school (he is going to K) I would have felt much better if he was going to be there with his sister.

Now I have to find new aftercare for him which means I will be spending a lot more money!! I was looking forward to saving money!!

Did you ask if there is currently a class in your home school? If not, you should and you should also ask how many students are in it.

Well, they don't offer them in all the schools because each school might not have 15 kids to make up the class. They might have, say 3 or 4. If they never have it, chances are they probably won't next year unfortunately. But, you never know! I would ask if the teacher thinks he would be a good fit for inclusion with maybe resource room, then see if your home school typically offers that

My friends children go to two different schools in our district because of the same issue. It is legal. The district does it to consolidate services and save money.

If I remember correctly, you are in the same district as me. My son receives speech, reading and resource room. My other son receives speech and OT. What services does your homeschool not provide that another school in the district does? I can tell you that you need to fight that preschool director and don't back down. She is a character and she hates giving services where services are needed. She tried to take my youngest out of speech going into K and he clearly still needs it. Thankfully I had a great relationship with my older sons speech therapist at our school and my youngest, although he doesn't have an IEP, she has him on her 504 and she makes sure he gets his services. OT I am not happy with in our homeschool. I have a friend in another Elementary within the district and her son needs vision therapy. The district had to find a vision therapist to come to the school and provide those services. She had to take him to his eye dr for the services until the school found one but they found a therapist and now he gets those services within the school.

Unfortunately (or fortunately depending on how you look at it) Most school district do not house self contained classrooms in every school. There are not enough children to fill the classes. You can always request that he stay in his home school and get a 1:1 aide but if they are recommending the class, the more structure and support of a self contained class can do wonders. Also, if he is still have potty issues, which I think you said, they will not work on that in a Gen Ed classroom. It stinks to have kids in different schools, but many many people have to do that and you need to think of what is best for your child. I have spoken to many parents who chose not send their child to a different school for the self contained classes and then regretted doing so in 4th or 5th grade because of the services and support that were not able to be given.
