im freeeeeeeeeeeezing (landlord ?)
ok, my windows SUKK i men they REALLLLLLLLY sukk.
i am soooo writing to my landlord that we need new ones. do ytou think thats ok? i mean, we cant open and shut 2 of them in fear tehy will fall out, and the rest dont close properly. my dogs have been shaking ridiculously for the past few days and i cant wear anything less than a sweatshirt, socks, shoes, pants.... and now im whipping out teh gloves.
WE pay our own heat and it was $450 one month last year.
isnt it illegal for us to pay our own heat and hot water?

Is it a private home or a building? if it's a building I *believe* they are required to provide you with heat and hot water legally. Here's something I found from NYC HPD - NYC Law Heat Info for Tenants
If I were you I'd call 311 and ask about this (this is exactly what it's there for). They get back to you really really quickly, esp for a heat or water complaint.

hmm.. well i live in a small building, but they crossed out on the lease 'landlord provides heat and hot water" so i basicallyt screwed myself...
but since we ahve to pay our own i should be entitled to tell her we need new windows right?

honestly, that doesn't nullify that clause in any way. unless it explicitly states "Landlord will NOT provide heat or hot water" (which I still think is illegal), you're still ok. I would give them a call.
As far as the windows go, I'd give him an option - either he can put new windows in the the house or you'll call HUD on him since it's apparently illegal not to provide heat or hot water.

Hello, this is Jessica Dwyer from XXX Bedford Ave #X here. I am writing to you about our windows. It is unbearably cold in our apartment. It was last year as well, and we ended up having extremely high heating bills every month. But in the past year it seems that the windows have possibly even gotten worse. Two of them we do not ever open and close because they appear as if they are about to fall out. We don’t even want to take the chance with that happening, so we do not touch those two. Also, some of the others, if not all, do not shut properly and have very strong breezes coming through. It is extremely cold in our apartment and is getting out of hand as everyday it is getting colder. Since we pay our own heat we were hoping that you can have the trouble windows replaced. In the meantime get some of that plastic stuff and put it up on your windows. They have it at home depot.Keeps out 99% of all drafts from the windows It helps ALOT.. no reason to suffer while you try to take care of it.

I live by this stuff. We haven't turned our heat on yet. Last year we only had it on a few nights.
