Ill be quite honest.. thus far i have yet to see a doctor act like that...
i really have worked with primarily excellent professionals
and honestly...regardless if the doctors are stupid...
there are serious steps into being released...
it isn't an awakening
"i am ok now" "oh you are?...that is great andrea...You are free to go"
it just isn't like that regardless if you are working with a idiot doctor
There is usually a team of professionals to fool

I think in this case, it was too high profile for doctors to just push under the rug. The community at large was outraged so every aspect was under serious scrutiny.
I would not expect a person who is not familiar with mental illness (and its treatment) to be able to separate the illness from the crime. If I wasnt bound by privacy laws, I could tell you stories of psychotic behaviors that would shock and horrify many of you. But to me, as sad as it is, it is all in a day's work.

I absolutely think she was insane. I hope she gets the care she needs - no matter how many decades it takes. It was a horrible tragedy. IMO, no sane could ever stand living each day with the deaths of their five children on her conscience.

I'm sorry, no matter what, she should have been sent to prison for the rest of her life so that she can live each and every day knowning what she did to her children. For God sakes, I read that she chased her 7 year old around the house to catch him in order to drown him. I'm sorry, this is my opinion and of course I have no right to judge b/c I have not walked in her shoes, HOWEVER, she did the crime, those poor little angels.......she deserves to be jailed FOREVER!!!!!!!!!
I am very familiar with this case given that I was interviewed on Court TV Radio (Sirius Radio) and Court TV (Bloom and Politan: Open Court) for a total of three hours discussing it as their psychology expert. I am a media/clinical psychologist. I think you need to ask yourself whether this murder stems from a bad place or a sad place? She was a very sick woman who had four previous hospitalizations, including past suicide attempts. People do not get help in prison. The research shows the mentally ill inmates live in the worst conditions in prison and deteriote very quickly. She sought help and she failed in receiving it. She was actively psychotic when she murdered her children. The law states that if a person is NGRI (not guilty reason insanity) that they are periodically evaluated. You cannot punish her for more time in a mental institution than she would have received in jail. Furthermore, if she receives treatment she can move on her with her life. Regardless of where she is kept, she will always have to live with the guilt. The problem with our legal system is that insanity is a legal term that judges and juries make (not psychologists). Hence, they are not trained in recognizing mental illness.

She is a sick woman, that is very true and she should be sent to a mental health facility to get the help she needs but she should never be free.
As far as her husband he should be in jail for neglect, as well as the doctors that treated her and anyone else that knew them and knew this was going on.

I agree with those who say she did get the right sentence - being in an institution... She reached out for help many times and was ignored. I do not know much about psychology, but it is obvoius that she was failed by many people. It seems to me that her husband was living in a dream that she would get better and go back to being the woman he married. My question is - if she was hospitlized before and it was apparent that her children might be in danger - was social services contacted? Did they make any visits to the household to inquire about the welfare of these children? There are many people at fault here, and as horrendous as it is that she killed her children, jail is not the appropriate place for her. Its not like she is going to be sitting in her room at the institution eating bon bons and reading tabloids. She will be getting intensive treatment, which is what she needs. She is not an evil person - this act she committed did not stem from hate it stemmed from the fact that she is very very sick and nothing was done to help her, only make her situation worse. Its a very sad case all around.

I was just speaking to my co-worker about this yesterday. The husband knew she had post-partum depression and he knew she was sick & needd help. Nothing was done about it. Then he re-married one year later & is living his new happy life. So unfair IMO. I think someone really has to be really mantally unstable to do something like this.

I haven't read the whole thread, but I think this is a fair punishment. She is clearly a sick woman and needs help. Hopefully she will get the help she needs. Those poor children.

I think she is where she needs to be, but as someone posted earlier, I do think that the "innocent by reason of insanity" needs to be re-defined. She was aware that what she was doing was wrong, and was able to distinguish between right & wrong, and technically that does not fit the description of the insanity plea.

Well to judge her and say things like this make us just as bad. I respect your opinion but who are we to judge her that way. We don't know what mantal issues she had and the type of life she lived with her husband. I'm not excusing her actions in any way, but I can not imagine being in her shoes and how horrible it muct feel to know you killed your own children.

I honestly believe that if she would go to prison she would be killed by inmates. One of DH friends works in a prison and the things those people do to others who have murdered or hurt children. I will just say it is not pretty. This woman makes me sick, her story makes me sick. I do not feel sorry for her at all. Her hubby should have made her get help before allowing her to get pg again. How sad this is!!!!
I used to work with a woman like this, she starved her baby to death. She clearly had PPD, severe PPD. Her husband ignored it and now her baby is dead. She got off for the PPD, she is in a mental hospital and fromwhat I hear it is no ballgame for her.

I so agree. Postpartum depression is a very serious illness that alot of people takes very lightly or does not have any knowledge about. I think that people should try and do some research on postpartum depression and mental sickness before judging Andrea. Her husband is to be blamed for some of what is going on. Putting her away in a jail cell is not the answer and it will in no way be beneficial to her but rather will make her worse. This woman needs alot of help nad support.

I feel the verdict was accurate and she is where she needs to be. I do however feel that her husband should have been held accountable in some way. He didn't drown his children but he left them knowing (and apparently not caring) that his wife was ill.

periodic reviews are strict Mental hospitals are no picnic.... IMO this IS where she belongs!
agree- I really feel for her. I know what happened is horrific for those kids but I do believe she is really sick.

I would think that the husband's knowledge of her condition and leaving the children alone with her unsupervised should earn him a charge of criminal negligence. Why doesn't the state go after him as well?

he decided to house them in the tiniest and most uncomfortable of conditions. he left her everyday to deal with the kids...he knew she wasn't well.
she will live with this forever. I doubt she will ever get out of the institution. Whether it be jail or institution, she will never be free of any of it. Until the day she dies, her life will revovle around what she did. It will be a constant reminder. There is no punishment worse.
The good that can come out of this could be that the clinicians study her case and make mental illness, PPD and other disorders more in the forfront so we all understand it more and can prevent this from happening in the future.
I only hope that she gets the help she needs.
My heart breaks for the kids.
My anger is more towards Rusty. I think he had this woman on the side all the time. I think he has a screw or two loose.

I wonder if he ignored her PPD wondering if it would give him a way out of the marriage, or if other men do that. I'm sure he never thought it would end up like this though.

Absolutely - For the life of me I can not understand how he stood by and let this happen to his children.
IMO - Andrea Yates, Rusty Yates, and all of the professionals invloved with Andrea's mental health have a hand in the murder of these children.
