Let's talk NY State Disability for maternity leave
Who is eligible for it?
Is there a minimum requirement like number of year worked at a particular place or jobs, number of hours per week, etc...?
Do you apply yourself or does your employer does?
Is there a website for more information?
How does it work if you stop working BEFORE you have the baby?
Do you get paid also? or you are just on bed rest?
Or does it add with the the 6-8 weeks disability after birth?

ETA: I only work 10 hours per week. Would I still qualify? I will probably make less than $170 per week also, won't I?

I get this - I don't know if its interpreted differently from company to company, but I what I get is 4 weeks off, full pay BEFORE the due date. Thats supposed to be the NYS disability. Then I get 6 weeks for a vaginal delivery and 8 weeks for a c-section at 2/3 pay.

I get this - I don't know if its interpreted differently from company to company, but I what I get is 4 weeks off, full pay BEFORE the due date. Thats supposed to be the NYS disability. Then I get 6 weeks for a vaginal delivery and 8 weeks for a c-section at 2/3 pay.
That's nice.
I worked for a company that had only 5 employees, I ended up getting fired and getting unemployment, but had I not I would have only gotten 6 weeks for a vag birth, 8 weeks for a section at approx $170/week before taxes.

If you are disabled prior to delivery you are eligible for the same $34 a day until you deliver at which time the 6 or 8 week clock starts.
Either you or your employer can file for the benefit. At my Firm I file for employees and we recieve the checks because we pay them for the time they are on disability.
This is a significant part of my job so let me know if you have any other questions.

NYS disability is 26 weeks. When I was PG with Noah I got all 26 weeks b/c I was on bedrest and disabled. Its $170 a week max. My employer took taxes out. Some dont. Depends on if you go through your employer or not. Larger employers will do it for you, smaller usually dont. Mine was direct deposit as the benefit was paid to my employer, they taxed it and sent to me by means of regular paycheck.

i just yesterday realized how screwed i am, i was in a bad car accident may 28th and have been out of work since with a broken collar bone and two torn knees,
i have used 17 weeks already, and wasnt aware that for a different diagnoses (my obgyn wants me out because of health issues im having) you STILL only have 26 weeks, i thought it was PER CONDITION...i have no idea what im gonna do now.

Your friends company may have a different policy.
You can take 26 weeks total, but you have to be truly disabled. I was out for 4 weeks before I had DS due to preeclampsia and it didn't give me any extra time.

That doesn't sound right. If you go out prior to delivery for pregnancy related complications, that can take away from the 12 weeks to which you are entitled under FMLA (assuming you are covered under FMLA). It shouldn't take away from the 6-8 weeks of disability to which you're entitled after the birth. If you have complications from pregnancy and your doctor certifies that you're disabled, you should be able to get disability for the period of time you're out of work prior to the birth. You're considered disabled for 6-8 weeks after the birth regardless of whether you were disabled prior to the birth. The only thing that should affect your ability to collect disability after the birth is if you had already taken 26 weeks of disability prior to the birth. You should check with HR and your disability policy though.

Sorry you're correct. $34 a day is the max. I've never had them pay less than that but I have never filed for a pt person.
The time off before delivery DOES NOT take away from your disability afterwards. But as another poster said there is a max of 26 week. At that time you would be eligible to apply for long term disability. "Normal" Pregnancy disability is 6 or 8 weeks but there could be other issues which would allow you to be out longer on disability.

I'm really curious about this too. I work part time (23 hours/week). Can I apply for disability on my own because I don't think my emplyer does it. How do we apply?
