he admitted that he was trying to kill himself by a head on collision. IMO, that's murder.

When did that happen?

when it first happened. not sure if he's changed the story since then, I wouldn't be surprised! Chat Icon

I don't remember hearing him admit that he wanted to kill himself. I remember allegations that people thought maybe him was upset and wanted to kill himself.

I think that he should be put away for a very long time, don't get me wrong. But it's not murder. It's vehicular manslaughter.

Well he did admit to it, back when it first happened. I even remember it saying that it wasn't the 1st time he tried to commit suicide.

I dont' think this should be a murder case. Of course I haven't heard the evidence but in my mind this is vehicular manslaughter.

I agree. I don't think this is murder at all. What makes this case any different from any other drunk driving case?

Cause he told people that he wanted to kill himself - so with that being said - he went out with all intentions of driving the wrong way on the road. He passed numerous cars and he continued to keep driving.

YUP and then he tried to botch his case by putting another mans saliva in his mouth before he took the dna test YEAH THAT IS SOMEONE WHO IS REAL REMORSEFUL!WHAT A DIK

Wow, I had no idea as this is the first Im hearing of him wanting to kill himself.

I've been following this story though.....I cant beleive I never read this part...Chat Icon Chat Icon

Well, if that is the case, and he did say it, well then, there shouldn't be any question on his murder charges.

I heard he hinted that he wanted to kill himself. He deserves to suffer for what he did. I hope they come up with a decision so these families can move on.

He said he was in"self destruct mode". But he also told the cops that he had a lot of scotch and hoped everything was okay between him and his girlfriend. If you wanted to kill yourself why would you care about how your relationship was between you and your GF?

Also, about the swabbing. Why would he want to botch that? That actually would help his case, showing that he had 14 drinks and he was extremely drunk. At least IMO it shows lack of judgment and responsibility. Someone unable to make intelligent choices and incapable of committing such actions like murder, so while people may think it was him, I tend to think it was botched by the Prosecution.

I don't see how purposely botching the DNA test would help him. I was just reading back in Newsday articles and this is something I found:

One of Heidgen's friends testified Monday about a letter Heidgen wrote him from jail months after the crash, in which he admitted lying to police when they first questioned him, before he knew people were dead, according to his lawyer. In the letter, Heidgen said that to protect friends who had given the party he attended, he told police he had been drinking at home alone after a fight with his girlfriend.

It just seems to me to much lying!!!

Because he originally said they botched the first test (dismissing this as proof in the case ) so when they went to do it it second time he tried to botch it again sooooooo the DNA Would not be admissable since they can't get it right AT NO FAULT of there own..

I feel the same way too. I don't see how this is murder in the second degree. I think they have the murder charge because they were saying that he deliberatly wanted to drive into someone?

He can only be convicted of murder if he shows no remorse, which up until recently he hasn't. He's a sick person who deserves what he's got coming to him.

To prove murder you have to show intent.

If they are trying to make this case a landmark case it is going to change the future of drunk driving charges.

Do all drunk drivers have the intent to kill when they get on the road?

DWI and DUIs in NY will be charged and handled more severely as well. Because when you get in the car drunk, even if you didn't kill someone and you get pulled over for drunk driving, they are going to say you had the intent to kill someone. Did you?

that isn't true either...

Remorse had nothing to do with it..

they had to prove wrecklessness and depraived indifference for life

Convicting someone on murder has NOTHING to do with the Defendant showing remorse or not. That is not what murder charges are based on.

Re: Limo Crash case

i highly doubt this will even set a presidence..

I think that charging someone for murder like this WILL NOT be the thing now...

AGAIN...what made this case is the WRECKLESSNESS AND DEPRAIVED INDIFFERENCE TO LIFE

NOT just that he was drunk driving and killed someone

Although I understand your point, at the same time - if you drink and drive, you could kill someone (many people have) so you are guilty of intent.
Sorry, I just had this argument with a friend and my opinion is you shouldn't drink and drive because you could kill someone and what Martin Heidgen did is inexcusable - especially when there were numerous people trying to get him to turn around and/or get off the parkway.
I'm glad he got charged with murder.
