I think this is why they have to have a trial -- I couldn't say without considering all the evidence.

My sister was called for the jury - but she wasn't picked in the end.

I think it will be very difficult....

It's so difficult to prove second degree murder in drunk driving cases. Also, two recent appellate court cases narrowed the definition of depraved indifference murder (what he is being charged with), making it more difficult to prove. Even though what he did was horrific, I think it's much more likely he'd be convicted of manslaughter, not murder.

He should be charged with murder! Chat Icon Nobody made him drink and drive but himself, he killed 2 people because of it. This was not an unavoidable accident. He should pay for what he did! If he gets charged with manslaughter he will probably be out in like 5 years.

most drunk drivers don't get charged with murder do they?

isn't it normally manslaughter?

I think he should rot

but Jake and I were talking about this last night- and I thought that maybe b/c it was a limo- she wasn't wearing a seat belt- and that contributed to her death

I hope they include mansluaghter as an option for the Jury- I don't want to see him get off on a technicality- that would not be right

But I cannot stop thinking about that poor woman holding the decapitated body of her little girl on the side of the parkway and refusing to leave. This guy needs to be punished. Yes while it may have been an accident, he certainly made plenty of destructive decisions leading up to the death of this poor little girl and the innocent limo driver. Their lives are changed forever bc some guy decided to get hammered and hop into his car.

As with any case, I'd really need to see all of the facts however...

My mother was KILLED by a drunk driver who was so smashed he had no idea he hit her (she was a pedestrian). She was pronounced dead a half hour later at Central General Hospital in Plainview. Clinical cause of death... severe head trauma. There was nothing the doctors could do, the damage was too severe.

This was not his first offence but it happened in 1979 before MADD really began lobbying to get the laws made stricter so he got off comparatively lightly compared to what it probably would be today.

I'll tell you who is really sentenced for this crime... MY FAMILY. My Dad had a very stressful life after that, my brother was 4 years old and well, I think he largely has the issues and problems he has today because of those events. I was eight and have very faint memories of my mother. She was not there for all of my major life events... prom, graduations, wedding and will not be here to see the birth of her grandchildrenChat Icon She died at 38, only two years older than I am nowChat Icon She was robbed and we were robbed because some a$$hole had to drink too much.

That poor girls family... not only did Katie die that day but her mother and father's hopes and dreams died with herChat Icon .

For obvious reasons it's very difficult for me to have any remorse for the driver and if I was ever picked for such a jury, I know I couldn't remain impartial. I'd have to be excused.

this is what gets me, the damage to the limo made it un-recognizable! that is reckless!

i think it should. his weapon of CHOICE - the car he CHOSE to drive while completely drunk. murder! no doubt in my mind.

do you know how many people have died due to a drunk driver..

the laws are there for a reason

should they be stricter? sure
Should the punishments be tougher? YES

But i think that there is MS for a reason..which is in fact for this kinda of situation..

i think they are playing off the public horror of the accident and trying for something that they shouldn't be

well for murder...as in the other post

there needs to be intent to KILL

that is the difference between the two charges..

this guy didn't get into his car INTENDING to kill anyone
