Long Island Teachers
Have any of you had a baby over the summer and been able to start your 12 weeks FMLA (unpaid) on the first day of school? No one in my union seems clear on if I can do this or not (shocker...) but I want to hold out a little bit of hope that I can do this! I'm going to go to HR and talk to them about it, but am just curious.

It used to be that we could.
In Sept., I started to hear that the B.O.E. now wants a very strict interpretation of FMLA... including the summer, despite the fact that we are 10 month contractual employees. We do not get paid for the summer, we pre-pay our med. benefits and/or take smaller checks throughout the year.
I wouldn't be surprised if several districts try to count the summer as part of FLMA. Unions should grieve. As little as 5 years ago, very few BOE would have tried that but the climate has changed. Not sure if a unions would even win a grievance on this issue... 5 years ago such a grievance would have been an auto win for the union.

Yes, my son was born in early August. FMLA clock didnt start until school opened in September. It ran out around Thanksgiving.

My son was also an August baby and my leave didn't start until september. I went until beginning of dec.

yes fmla starts in sept. you legally have 12 weeks per year to take leave from work holding your position and insurance.
however the question becomes will your district let you use your days concurrently. that is up to the district.
my district allows you to use sick days throughout the entire 12 weeks. some districts only let you use your sick days for the first 6/8 weeks then you are unpaid.
so those are the questions you would want to ask.
and remember fmla is 12 weeks calendar time. not school days.

see this always confuses me bc I do not think that is legal.
according to school law it says "Absences of one or more weeks when school is closed and employees are not expected to report to work do not count against FMLA leave entitlements"
now to me i would interpret that as the summer. but interpreting the law is not something i am an expert at.

I had a baby on the last day of school June 2009. My FMLA started on the first day of school in Sept. I took 10 weeks because that's what I could afford. So yes, I was able to do what you are hoping! Unfortunately I did not get paid for the 6 weeks I would normally get since it was over the summer, but it was what it was. This time I'm due in May, so I'll be able to get paid my 6 weeks.

I have had late.june and early July babies and did this With both.of them. I went back to work after Thanksgiving so i basically had 5 months.off eith each of them. However the time was completely Unpaid. I could not use accrued sick Days because by september, the 6_8 weeks "recovery" had passed.
