NYC Teachers and Maternity Leave
Whats the situation with getting your tenure and being on maternity leave?
I ask because... I plan on starting IVF probably mid November. Figure by December (if of course it works) i get pregnant. Due date would be about September. This is my tenure year so would i technically get tenure in september? Someone at work said I can loose my job if im not tenured? Isn't that against the law?

I am not a NYC teacher, but I believe for tenure it is 3 years and 1 day of the following school year.
Also I do believe it is illegal to fire you for being pregnant. Perhaps, she meant you will possibly lose your placement.

yea "loose" my position which i thought was also illegal... ?

If you return in September before you have the baby, then you would get tenure before you went out on Maternity.
If you didn't go back, you would just get tenure the day that you returned from maternity leave since you finished this year out in full.
Normally, tenure just gets pushed back the amount of time that you were on leave.
I think your only worry might be being excessed, but that is based on subject area and senority, so tenure wouldn't even matter in that situation.

ohh good to know! even if you are excessed though you still have a steady paycheck until they find you placement. right? OMG the last thing I need is to have a child and not have a job- its one of my biggest fears..... sorry to sound so dumb right now! im starting IVF next month and Im just reassuring myself that I will have a steady income coming in and everything will be ok...

no, you can't lose your job. With my first I was preg during my tenure year, it didn't effect it at all. They only thing is I believe the time you are on leave doesn't "count" towards the accumulated time.

You are tenured after three years from your appointment date. If you take a maternity leave during this time, your tenure date gets pushed back.
TECHNICALLY speaking your school district cannot fire you for being preggo or taking a leave. They can eliminate your position and put you in excess while you are out on leave. (But tenure doesn't protect you there; lots of tenured teachers are excessed in NYC).
