NYC teachers ONLY-Anyone know or have experience with FMLA and/or Ext Childcare leave??

I have been trying to call someone at the Queens UFT and they are not calling me back and of course she is the only person who deals with maternity leave. Called the main UFT number and they said you have to go to the borough you work in. What a shocker everyone is so helpful.

If anyone has first hand knowledge can you FM me please.

From what I understand your maternity leaves begins the day you give birth or sooner if you have a doctors note. You get 6 weeks for vaginal delivery, 8 weeks for c-section. You can use the days in your CAR to cover your maternity leave and borrow up to 20 more.

your FMLA runs concurrently with your maternity so you get an extra 4 or 6 weeks respectively. You cannot use your CAR to cover the FMLA, they have to be unpaid.

If you want to extend further than that I believe you have to get approval if you want to come back at any point mid-year.

that pretty much sums it up...

If after the FMLA is up you can go on childcare leave.

I stopped working 1 week before my due date. I took sick days.

I didn't start my maternity leave until the baby was born. I got 8 weeks because I had a c-section. FMLA ran concurrently to the 8 weeks so after that I had four more weeks. Once that four weeks was up I took a child care leave.

I went out on Jan 15 and returned to work May 29th.

I learned the maximum with FMLA is 12 weeks.

This is similiar to what I did as well. I ended up extending my leave each year and was out for 6 years. You have until your youngest child is 4 years old to return or resign. There is no guarantee though after a certain amount of time that you can return to your school. Luckily I have a large school and was able to reclaim my spot. Good luck.

I also need this information! Does anyone know how long your insurance stays in effect until? Also I know that you need to use the days in your bank for maternity leave in order to get paid, but what happens when u are on a school break? Do you have to use a day out of your bank if its not a school day?

I'll have 22 days I believe in my bank when I go on maternity leave, and I know I can borrow up to 20 more. So is that 42 school days that I can be on leave for and still get my regular salary? Then after that I wouldn't get paid, but will I still have my insurance for a little while after?

You should call Sheldon Hychman. He is the FMLA God. I will post his number tomorrow...it's in the records that I keep in DD's room and she's sleeping now...

Anyway...you are entitled to 12 weeks of leave--ONLY SIX OF WHICH WILL BE PAID. Even if you have 100 days in your bank, you can only get paid for 6 weeks. They say that a c-section entitles you to 8 weeks of paid leave, but now your dr. must confirm that you were medically unable to work due to the c-section to get that extension. The FMLA leave and maternity leave run concurrently. Also, if there are any week vacations within your FMLA leave, you do not get extended. You basically lose those weeks. This does not apply to the summer.

My benefits got effed up so badly and they are still effed up 9 months later. I am getting ped bills in the thousands for my DD so make sure you stay on top of EVERYTHING.

Also, I never called the union regarding anything. I used my payroll secretary and Mr. Hychman exclusively. I just recently contacted the union regarding my termination of benefits and no one has responded to me.

You keep your benefits for 12 weeks. You can take a longer leave, but you don't keep your benefits. Chat Icon

If there is a day off during your first 6 weeks (assuming v-delivery), that day does not come out of your bank. So I was out for Yom Kippur and didn't lose a day for that. You don't get paid for anything during the next 6 weeks.

Once you deliver, you can only be paid for 6 weeks (or 8 weeks if you have a c-section). You can't take more days even if you have them in your bank once you deliver, but you can take them BEFORE you deliver....which is pretty hard to plan out unless you have a scheduled c-section date.

It's a huge headache....my benefits were screwed up, I know Snickers posted that hers were even worse....mine were cancelled 6 weeks after I returned to school, they sent me a check in error and then I had to pay it back over 3 months, it was forever before my pay was back to normal AND they take a small part of your summer check away because you weren't working to earn it. I took leave in 2007 and unless things have changed, you can take something called SLOAC (Special Leave of Absence Coverage) and keep your benefits for a certain amount of time. Of course, your payroll sec has to be aware of this and fill everything out correctly. I was out 14 weeks so for two weeks I was under SLOAC. Like many others, I was dropped from everthing even before my 12 weeks was up. Chat Icon It's kind of sad to say that I feel lucky that the screw up wasn't too bad- it shouldn't have happened at all- but with NYC you have to expect problems.

I'm not sure if things have changed since 2007, but my payroll secretary told me I had to be back in 12 weeks to keep my benefits (that was Jan 09) and my AP was told the same thing in June.

I just found this on the DOE website, it's a pdf.

I asked about this awhile ago, and found out that there are maternity leave workshops that you can register for. I Email/call this woman for info:

They schedule the workshops according to due date. The information they need to schedule you is your due date, file number with a non-DOE e-mail address.
