NYPD "Rape Cops" cleared of all felony charges;...
Moreno & Mata acquitted... But guilty of 3 misdemeanor charges each and could face 0-1 year in jail...
Any thoughts?

See I don't know though... Like everyone else I was absolutely DISGUSTED when news of this event broke. It was so disturbing, and GOD KNOWS I had my share of those "too much to drink" evenings when I literally stumbled home out of a cab, kwim?
But part of me wonders if we're getting the real story in the media; i.e. if a jury acquitted them there HAD to be something that didn't add up right?
Not to say I think they're Prince Charmings, not at all, but what was the deciding factor in the acquittal???

I'm thinking that there was no real, hard evidence that anything happened. They had the tape where he admitted using a condom, but that doesn't = rape. So while there was probably a lot of circumstantial evidence, there was probably very little they could use to convict him of rape...
ETA: If nothing else, I'm glad they're getting in trouble for their conduct. They should never have been there in the first place...had he just done his job & left, not gone back and "comforted" her in her bed there would be nothing up for debate...

I don't think they conducted themselves appropriately at ALL....With that being said, we're relying on the testimony of a completely WASTED woman who was blacking out. There had to be more to this story especially if they got off. I can't call them disgusting because the story seems a bit 'off' to me. They were in the wrong 100% for the actions that they admitted to but I don't think what they did was disgusting and I personally do not think this was "rape."

ETS: I was always under the impression that having sex with someone in the condition she was in, was considered rape? And if it's not, it probably should be. If she's passing out, she's obviously in no shape to consent to it.

Exactly. We do not know the whole story, only the jurors do, and i have to assume that there just wasn't enough real/hard evidence beyond a reasonable doubt to convict them of rape it's too bad because i'm sure something bad happened and it probably was rape, but because of her inability to remember and her condition, she just couldn't give convincing enough testimony. I'm glad the jury took this long to come to a decision though, you know they didn't take it lightly.
ugh, i feel so bad for her

I agree, and i too hope it didn't play into their decision. I've been on enough juries to know that it probably came up, but they really do have to rely on the facts and the facts only - NOT any preconceived notions of what probably happened due to her condition

I had a feeling this was going to happen, the jury was taking a long time to deliberate.
While I think the one guy is a complete azzhole and the stupid partner "went along for the ride" and looked the other way, I was not completely convinced, based solely on what was in the news, that rape occurred, it's hard to decide.
But definitely a scumbag.

This is what kills me:
During the trial, Moreno told jurors he lay alongside the woman in her bed for a while, but that he never had sex with her.
My DH is a cop and he is FLOORED at this. He said- to lay in bed with some woman, while you are ON DUTY and IN UNIFORM. That is so far out of line it isn't even funny. I just really feel these guys are guilty. So does DH. Horrible....

Disgusted as well.
I do think she was raped. Looking at NY's Penal Code, the lack of consent involved includes the following in their definiton:
Mentally Incapacitated: when the victim is made temporarily incapable of understanding or controlling his or her conduct because a drug or other intoxicating substance (e.g. alcohol) was given to them without their consent.
I'm not sure of the evidence that was presented but I"m assuming the defense was able to give the jury reasonable doubt. How she was in a state to consent to beyond me.
