i agree with the pp i am not surprised. I work for an insurance company and see people like him come in all the time for several DUI's. It makes me so mad. We have even had to call the cops on a gentlemen who came into our office to make a payment who was completely drunk.

My thoughts and prayers are still with you and your family.

That's why the first time you get caught driving drunk, you should lose your license for good. No second chanes, just like the people who are hurt and killed have no second chance to avoid these idiots.

This is why we need to make the laws stricter.

In most cases, people like that have no regard for anyone else so, why do some people consider them and their feelings so much that they do not punish them enough after they commit a crime??

I'm SO glad to hear that your SIL is doing better! That is wonderful news. I don't know if your family is aware of what a Victim Impact Statement is but they will be allowed to make one in court when this person is sentenced. Perhaps her daughter could do one -- or, how wonderful would it be if your SIL is well enough at that point to deliver it herself! Unfortunately for my brother, he can't give one himself but I'll be doing it for him.

agreed.... I honestly believe these people *think* they're still ok enough to drive... I don't think there's any way to 'teach' them that they're NOT.

then again, alcohol inhibits proper judgement... so it's sort of a cycle.

I hope you SIL gets better soon Chat Icon

I understand what you are trying to get at here - but, does that make it OK that they drive like that? If someone hurts or kills someone the fact that they "thought" they were OK excuses them from punishment?

I'm not trying to single you out or anything - I just really want to wrap my mind around this thought process as I have heard it, here and there, from people and it makes me wonder. Does this mean that drunk drivers shouldn't be given harsh punishments or should be made to accept responsibility for their criminal actions?

I've been reading your notes on Ken Dani and I *swear* your statement cannot help but bring the real IMPACT home to those in attendance, including that driver, hopefully. My brother's a lawyer so I know the case will be handled well (not by him); he's already said he doesn't want to crucify this guy, or the business that owns the van he was driving... he's content to let the insurance companies duke that out.

If the guy loses his license after this that's probably a good thing (given his prior) but I *really* hope he enters treatment either of his own accord or by being mandated. As bad as things look for him now, it will be much worse if he has the opportunity to do this again; next time I fear he'll kill someone Chat Icon

Oh God absolutely NOT; I think wannabemom's saying that that is just the thought process, not absolving them of responsibility... I have a friend who SWEARS he drives BETTER after smoking a joint. It's pathetic and none of us can get through to him. I feel like as the years go by and he stays "lucky" he believes his own bs more and more. Just WILL NOT listen to reason, it's unbelievable...

Re: OK soooo a little research shows the guy who almost killed my SIL last week...

Thanks for clearing that up.

I didn't know if that was what she was getting at and I didn't mean to put her on the spot -- it's just that I get that kind of mentality a lot and they mean it that way. People say TO MY FACE - well, it's not like that guy meant to hurt your brother. Chat Icon I don't know if they realize how much THAT hurts ME.

What exactly did he mean to do? When someone drives with NO license, NO insurance, and with a BAC so high that you wonder how they were able to WALK... and is going over 75mph -- what exactly are their intentions? HOW can that kind of behavior NOT lead to someone getting hurt or killed?? I said, how could he even keep his eyes open being that drunk?? Well, I got my answer when the detectives told me he nodded off when he hit Kenneth.

It is as bad as someone taking a gun and firing it, at random, into a crowd of people -- wondering if it MAY or MAY NOT hit someone. That is the level of negligence we are dealing with and I still find people who will excuse his behavior. Chat Icon Do that if you must but why do it to my face??

I know what you mean!

After Steve's accident... the cops asked the driver if he saw Steve... and the guy said "Yeah, but I thought I had enough time to make it" - UMM... yeah, waiting 1 more minute could have saved my husband from so much pain, suffering, scarring, emotional trauma, etc!

Maybe you didn't mean to.. but you DID. KWIM?

Colette - I am glad to hear your SIL is improving so quickly...

Unfortunately, I work with the SCPD and when Officer Ciano was killed we were talking about this very thing...no matter what the laws are, these people will continue to drink and drive - license or no license...it's so easy to just call a cab, but most of these azzholes just won't do it....Chat Icon

You're probably right about people doing it anyway with no licenses. Then we just have to move to incarceration and criminal records that'll hold people back professionally and financially. Whatever it takes....

There is no question that you are 1000% correct...but that doens't stop these guys...every time you hear about a fatal or near fatal DWI accident, the drunk is more often than not driving wi/out a license and uninsured....I don't know how it can ever get put through their thick stupid heads...

Maybe not but we can punish them at that point harshly. If these people are that self centered the only thing that might stop them is taking away their freedom. If we take their freedom, their cars and auction them off, etc. then other people thinking about doing the same thing might stop and say, I'd better not or else I'm going away and my car that I'm driving illegally is getting TAKEN from me - for good. Believe me, a lot of people will start to pay more attention and be more mindful of what they do if you take things that mean something to them. Right now, we are taking nothing and most of the time - they are getting "slap on the wrist" sentences - THAT is why others continue to do it... b/c "what's the worst that can happen?" is what is going through their minds.

I agree.

I was reading the story about the accident in Smithtown yesterday where a woman was killed by a drunk driver. (A poster on here knows the womaChat Icon ) The driver was arrested and given $75,000 cash / $150,000 bond! WHY??? That needs to change.
And of course he was convicted in 1999 for driving while impared.Chat Icon
