Thats funny I was just talking to my HR person at my job today about this.
My job offers short term disablity and that is it for 6 weeks. But I am not planning on returning to my job at all. Because I do not like it there and I will start looking for a new job a little while after the baby born.
Do any of you girls know if I am stll entitled to short term disability even if I am not coming back to my job? I am telling them before I go out that I am not returning.
I wouldn't tell them you aren't planning on coming back. That way you can be sure you get your disability.
I believe they can deny you and terminate you on your last day so that you wouldn't qualify for disability.
You would just need to go back to work for one day when your leave is over and resign.
Just apologize and say you intended to come back, so you don't burn any bridges.
(PS - I'm in HR. If anyone ever finds this post I'm probably fired!! )
I totally agree with that.
Some co-workers in the past just resigned on the first day back. It sounds bad but they would have been given grief and trouble by our Cie. They had to take care of themselves!

Re: Questions Re: maternity Leave
Our H said that regardless of your combined leave time employees are not ensured job security after the 12 week mark and it doesnt matter if the 12 weeks is a combination of Maternity leave then unpaid leave. FMLA only protects you for a 12 week period.

Re: Questions Re: maternity Leave
If you work for a small company your job protection is very little. NYS disability only pays you a % of your pay to a max. of $170 per week minus federal taxes. 6 weeks for v-birth, 8 weeks for c/s. It is for you to recover from birth, not to care for a newborn. The US s ucks at maternity leave.

i'm really confused by this issue too.
but my question is: we keep talking about 6 weeks vag. and 8 weeks csect. but what about the time you are out before the baby is born? my doctor is pulling me out of work at 25-26 weeks (which is soon!). am i entitled to disability for medical issues prior to the baby being born??

yes, you can be on disability before you give birth for bed rest, etc.
STD does not kick in at my job until after you are out for 7 days. Again, you are not protected against losing your job. You can start FMLA you give birth.
Let's say you are out 2 weeks before birth on bed rest. You have 6 wks STD... you can only take another 4 wks off (covered by FMLA). For a total of 12 wks. You can always take time off. Some people take 14 wks, etc... FMLA only guarantees you NOT to lose your job for 12 wks while you are out on sick/maternity leave past the time allowed by your Cie (usually 6-8 wks)

My insurance covers me for 2 weeks prior to birth. I am sure if you doctor said you need to be out of work , they should oay you for that time. You will need to speak to HR
