Spinoff- photographer moms- I have a question

Why do the photographers own the right to the pictures of your family? It doesn't make sense to me- the photographer should charge for all time spent taking and editing the pictures, of course, but why should you have to pay more for the final product?

I am with you Keri, I don't think it's rude, I truly don't understand it. Why take the pics and edit them if you aren't going to give them to the family? What good do pics of someone else's children and family do you? Chat Icon

plus that's how they make money... by you ordering pictures from them instead of a place like snapfish or whatever - KWIM?

Yes, but books, movies and music are all their own creations- assuming it isn't a biography on someone else.

Why do they need to be copyrighted? If I wanted to pass a picture off as my own- I could just order a print then tell everyone I took the picture. . .

ETA: Hayley- don't they make their money by taking the pictures?

pictures are THEIR own creation too...doesn't matter who or what the pic is of

you could do that, but it would be illegal...just like if you plagiarized

I am torn, I DO see the value they add and most are VERY talented but I think some of the prices I have seen (even here in NC) are outrageous

Someone here in Charlotte quoted me $800 for pics and the CD....Chat Icon

I found 2 ladies who are just as talented and I pay $150 for a session (no time limit), the edit the pics and then I get full rights to the pics on a cd, I can print them from wherever I choose and share them as I want

I guess my own confusion is why do some photogs do it, and others don't? The one I use charges for her time and editing, and them uploads the pics to a website I can order from AND gives me a CD of the edited pics. I mean, really, once I pay her, what does she need the pics for (other than on a website/blog to show others her work). And if she wanted to charge extra for editing/travel time/work time, great, fine, I get that, but that should include the pics taken and edited IMO. Like I said before, what good would pics of MY family do them?

Most photographers that I've seen don't charge much for just taking the pictures...

Once you are able to print them yourself, you're not going to go back to them for prints - KWIM? So they will lose out on that money so it makes sense for them to charge more for you to have all of the printing rights to the pictures.

It wouldn't do them any good probably...unless they wanted to use it for their portfolio etc

Copyright laws are pretty strict....for example, I teach a course at SUNY--some of the research papers I use for the course I MUST cite on the cover page and put a clause on the site (through SUNY) that it is NOT to be copied and used ONLY for the purposes of this class. It protects the intellectual property of the authors (or in this case, photographers).

Why some wouldn't...maybe they want to keep their prices down...but like a PP said, its an open market and people will use who they choose

Theres plenty of reasons.

One reason I learned the hard way. When I first started out, as part of my portfolio building, I offered CD's dirt cheap. And handed them over, without realizing they should come with a release/contract stating what they can be used for. This client (no one from here so I feel comfortable sharing) went on to EDIT and ALTER the pictures I took. She did a crappy job. And then posted them on myspace as pictures taken by me. I'm sure she thinks what she did to them looked good, but to me it looked cheap and ugly. I went on to comment on each photo that the additional editing was not done by me. Now i know to NEVER hand over the full rights to MY photos, regardless of the subject. It made me look bad and I will never again hand over the rights. Printing release - yes, if paid for.

I personally don't understand.

I see it as I paid someone to take a pic of me and my family. I paid for the service. Deal done! Just like if someone did a painting of you. You paid them, they give you the painting. It would be like paying for someone to paint a portrait but pay again to actually get the portrait.

I don't pay for someone to take pics of me and then told me it's more money to get the actual pics. What's the point?

I want a price where I get my pics. Not a "here is a bun for your burger, the burger is extra".

Of course, there is skills but if you are "commissioned" by someone to take pics of them. So your price should reflect your skill. I see it as I paid for the job already.

Now, if a photographer take a pic on their own of a landscape, people, etc... then yes, I agree it's theirs. Nobody paid for it.

Right, and thats why most photographers offer print packages.

I think it gets blurry when there is editing done (no pun intended WAMP WAMP) but in general I am with you so when I get pics done I make sure the package I buy includes ALL the pics for me to print as I please. As far as altering them- I never really thought about it much b/c I stink at that type of stuff and never even tried- but I can definitely understand why a photog wouldn't want their pics edited badly and then displayed for the world to see...

I think the whole think has become blurry because we paid, we think only the paying person has the right to the pics being taken.

Also because people are now used to uploading pics on their own and doing it cheaper. I have heard of crazy mark-up on the pics by some photographers.

My SIL is a photographer and my DD's godmother is as well... after talking to them I've come to understand the high prices. This is their work, their craft. It really is an art... I've taken pics with my girlfriend's camera - I think it's the same camera that many of the photographers we all love on here use... let me tell you, I don't get the same result when I shoot it myself. They may not have the same emotional tie that we have when we look at pics of our families, but if it's a really great picture they want the right to say "look at my work!"

And I just thought of this in regard to the poster who mentioned getting a painting - Picasso may have painted pictures of certain people for THEM, but all anyone cares about today is that Picasso did the painting kwim?
