Update: Photographer not releasing our pictures (long)
Update: The photographer is giving us our pictures on a CD!
We took pictures last week with a photographer. She told us that we would get an online gallery of our pics and we would be able to order prints from her. To my surprise, all the pictures have a giant "PROOF" written on them. We also cannot save the pictures from the online gallery.
I am so upset.
Is this normal for a photographer not to release the pictures to you and only sell you prints?
She charged us a small fee but never disclosed to us that we would not get the pictures. I thought it was just assumed.
What would you do?
1. Just buy the prints of pictures you like 2. Offer her more $$$ to get the digital pictures 3. Print screen and have the pics with the word proof 4. Other?
Do I even have a right to be upset?

I think they all belong to the photographer. I bought a DVD of all pics from our photographer, but that's a deal we made with her. If I didn't, the pics are owned by her and she isn't under any obligation to enable me to save them without her making any money from it.

This is standard.
Your photographer owns the rights to the images she took, not you.
You can order prints from the photographer or you can buy the right to specific images and print on your own or buy the whole CD of images.

So I guess I am out of luck.
I've only done engagement and wedding pics and we got all our pictures. I never realized we had to clarify that we wanted the pictures after the shoot. Lesson learned.
I will probably offer to pay her for our favorite pictures. Hopefully she will sell them to us at a reasonable price.

You paid the photographer for the services...her/his time of taking the pictures
We did this and bought the CD, then you have rights of the pictures

yes...this is standard. I just paid as part of an overall package to get the high-res DVD of all my images (100 pictures) as well as a release to reprint. It would have been 225 if I just wanted the CD.

I believe I paid somewhere around $100 for the DVD. That was separate from the cost of the shoot itself.

unfortunately for you, that's very common.
we always make sure to purchase a package where we either get the rights to the pictures or a DVD of them.
it can cost anywhere from maybe $300 - over $1000 depending on your photographer...

I'm sure the photographer has a set price for it.
But to answer your OP, yes, that is standard. The photographer usually discloses this to you, but they are her property

completely normal and rightfully so. I am a photographer and I would NEVER sell my rights to any photo I take. I do sell printing rights but no real photographers that knows the law would ever sell you the rights to a photo. Copying them from the website is wrong and illegal. If they gave you the photos for just the session price then you would take them and never order through the photographer and would probably print them up through crappy places like Walmart. So the photographer wouldn't make any money for all the time spent post processing your photos. I would order the prints from the photographer to get pro quality or ask if you can purchase the printing rights to them.

I think this is what I meant to say...we purchased the printing rights to them
Then went to mpix (as suggested by our photographer for the quality) and printed some there

I am going to contact her in attempts to buy the CD.
After more careful inspection, I see that the online gallery offers image download for $35 each. If the CD is really expensive, I will just pay and download my favorites.

HOLY CRAP! That's out of control. $1000 for 20 pics. I am def in the wrong business.
And when we used a LIF vendor, I got a gallery PW and was able to save ALL pics she took of DS. I can't remember if I got a Cd, but I got ALL proofs.

here in charlotte, I got the whole thing (CD with full printing rights) for $150
another photog wanted 500 EXTRA to give me the CD...ridiculous

No contract.
It's my own fault. We've done other shoots for engagement and wedding. I never asked the other photographers if we could get the pics afterwards. Granted they charged a lot more.
I have emailed and called the photographer. I hope she is reasonable and sells us the CD.
ETA: If anyone is wondering, this it not an LIF vendor.
