The weight depends on your carseat. I have a Marathon which goes to 65 lbs which my son is nowhere near but he was at the height limit for it so we went to a booster a year ago when he was 4. I needed the Marathon for my younger son so it worked out well here.

Children under age four are required to be restrained in federally approved child safety seats when riding in a motor vehicle. If the child weighs more than 40 pounds and is under age four the child may be restrained in an appropriate child restraint system, which includes the use of a booster seat. In addition, children age 12 and under should ride properly restrained in the back seat. This position is safest as they are less likely to be injured in a frontal crash or from a deploying air bag.
