Re: What REALLY happens if you get summoned to jurty duty..but dont go?
I served twice, once here and once in another state. The time I served out of state, I didn't get the first notice and I got a LOT of attitude when I called to request a postponement when I got the second notice. I got the impression that they don't fool around with this stuff.
I must be the only freak that likes jury duty, but I have a government job that pays me if I miss work. Now that I have a child, it would probably be a PITA with daycare dropoff and pickup, but I don't mind spending a few days catching up on my reading and I find the actual trial really interesting.

Re: What REALLY happens if you get summoned to jurty duty..but dont go?
Thanks to those who understood my point and elaborated on it. I've gone for a long time keeping my mouth shut during the discussions about getting out of jury duty. It's not a responsibility that we should shun simply because we think that someone else should do it! For those who missed it, my post was the first response on this topic. I feel strongly about this and I am glad I'm not the only one.

You can only be called for jury duty if you are registered to vote. So it's not a random sampling of the population, it's a random sampling of registered voters.
Maybe in NY but not in all States.
Many years ago, I received a Jury Summons when I lived in NC. I was "fresh off the boat" with my immigration papers.
I called them and asked them how they got my name since I was not allowed to vote. I was an immigrant with just a green card.
The lady told me they got my name from the DMV. She wrote my name off the list.

You're not the only one by any means.. i have never understood why people think jury duty is such an aggravation.. To me, it's a fascinating glimpse into our legal system and as citizens of this country, its something everyone should have the opportunity to experience. Everyone in this country has the right to a jury of their peers - but how would most people feel when/if they have to be on trial, knowing that the jury was made up of people who didn't want to be there? It's fine for people to complain that they don't want to go to jury duty, but if they were ever to need it, i'm sure they would want people on the jury that were giving the case the attention it deserves. I understand that some people have a hard time judging other people's actions, or making a decision based upon the law.. and for those people, the judge usually dismisses you if you really can't face that sort of decision. I just get so upset that people don't take it seriously.. (yes, i've done it)

I'm on my 2nd week of calling in. I haven't had to go yet. I only have to call for 3 more days. If they want to put me on a case, I do have a hardship. My husband is mentally ill and is still in the process of being diagnosed.

I gotten out of it because they sent me notices all through my college years and when I was studying abroad. Then the one time I got s summons where I would have been able to attend was last year. By then I had moved out of NY and was living in NJ.

I've already corrected this misconception. It's not true in NY either.

Re: What REALLY happens if you get summoned to jurty duty..but dont go?
See the funny part is I would actually have liked to have served when I was working - but I never got the chance. The only time I have actually gotten a summons was when I was a 1st year in law school and I got summoned the week of my semester finals - so they exempted me. Then recently I got a questionaire under my maiden name to an address I haven't lived at in more than 10 years. But I can't serve now even if I want to b.c I have a 21 month old DD and a SAHM (my whole family works) and I'm 32 weeks pregnant so I would have no one to watch my DD.
The thing is I think a lot of people see jury duty as a pain and I know some jobs do give people a difficult time when they are forced to go to jury duty.

I'm also dying to be on a jury. The only time I got called for jury duty, they called a small group of us into a room in the middle of the afternoon and told us that they were sending us home. I never got called in to get questioned or anything. I just got excused. I was very close to saying, "but I WANT to serve" Everyone else in the room was so excited.

Re: What REALLY happens if you get summoned to jurty duty..but dont go?
I got called one time for jury duty and got dismissed- I was so upset- I was really looking forward to serving- but it was an insurance case and my mom is a nurse so it was a no-go.
I think its a privilege to serve on a jury and I hope I get called again.

My brother just went through this.
He ignored 3 letters summoning him to jury duty....he finally showed up to court when they summoned him and threatened to hold him in contempt...
He paid a $50 fine and was assigned immediately the next week to a case which he is now serving on.
He was so dumb to ignore it, the judge told him it could have been a LOT worse-he could have served some jail time for not replying to the summons!
I'm sorry but Ithink that is ridiculous. I'm sure there are enough people out there willing and able to serve on juries...why do they have to force people
I don't think it's ridiculous at all - this is one of the founding principles of our democracy, and one of our essential freedoms that SO many people take for granted, a fair trial by a jury of our peers.
I'm sure there are some who are willing and able to serve on jury duty, but I assure you, at least in Philadelphia, there are NEVER enough people, and what is most essential to a proper, fair and functioning trial by jury is to have a random, distributive sampling of people from all walks of life from the most educated, hard-working, busy, career-oriented, to the less educated, unemployed, SAHM's or people who have more time on their hands to allow more freedom and ease to sit on a jury.
I know for myself if I ever had to have a case against or for myself before a jury I sure as hell would want a good sample of diverse people with diverse backgrounds to make sure my trial was as fair as possible. That is a right and a privilege that everyone enjoys in this Country which is not the case in other parts of the world.
Agreed 100% with Beth.
I never thought of it like that-that is true

I'm with you! I've served twice but never got called to sit on a trial. It gets me so angry when people I know try to get out of it because 'it's inconvenient.'

Re: What REALLY happens if you get summoned to jurty duty..but dont go?
I got a summons and messed up- I was supposed to mail part of it back and didn't realize it. But I did call like I was supposed to and my number did not come up. A couple months later I got another summons and this time I mailed the part back, and called like I was supposed to.

You can actually volunteer for jury duty in NY.
It is also possible to volunteer for jury duty. You may do so by contacting your local Commissioner of Jurors at (845) 486-2697 or calling 1-800-NYJUROR.

My DH always throws them away I believe it to be my civic duty and go each time, except when I was 9 months pregnant. We agree to disagree on this topic.
But to answer your question, nothing has happened to DH in the past 20 years.

Re: What REALLY happens if you get summoned to jurty duty..but dont go?
unless they send it to you certified mail, you can argue that you never received it. I know I am currently doing that because I served (by phone but technically I served) last year and they just sent me a letter that they have sent me a bunch of letters (that I have never received) to serve. I will not take a fine. They cannot prove that I received anything unless they send it certified or accepted a signature!

Sorry for kinda hijacking, but how do they choose who they call for jury duty and when? I've never been summoned (in NY or FL).
It varies by state, but it's generally pretty random. I moved a couple of times between 18 and 25 (to different states). I got called once in NY after I relocated to NC. Then I didn't get called again until I moved back to NY. I didn't actually serve jury duty for the first time until I was 26 or 27...
Ok, thanks! Coworkers and friends always talk about it and I kinda want to experience it, but have never been called. I'm 29 and have had my license, been registered to vote and everything since 18 and have never been summoned.

Re: What REALLY happens if you get summoned to jurty duty..but dont go?
I would love to be called and actually be on a trial. I think it would be interesting. My Dad was on a jury a few months ago and loved it. He thought it was so cool how everything worked, and the guy that they were prosecuting lived around the block from them!

Re: What REALLY happens if you get summoned to jurty duty..but dont go?
Honestly...go...dont pretend to not receive it. Just from my experience as much as you dont want to be on it they dont want you on it if you are going to not be openminded.
I dont think its out of the ordinary for people to not want to go. I had a daughter to drive and pick up at daycare, I had clients to see all day. I dont think I should be forced to do something that I really cant do right now. Meanwhile I agree with you that IF I had the time I would be fine with going. 10 yrs ago, 5 yrs ago...I ws your perfect candidate...NOW??? not at all. Not to mention that why would a lawyer want me on a case that I DO NOT want to be on??? It would only screw up their case. Basically I was called. I did go and I got dismissed bc I pretty much didnt want to be there. Also, in regard to the diversity...I also agree that I didnt see much diversity. Strangely enough, everyone in my room was sitting with masters degrees.

Hmmm....I wonder what kind of can of worms that could open...but...good point! Could you imagine if they had to start doing all jury letters certified.
