WWYD - possible insurance scam/fraud? LONG! UPDATE
UPDATE:
DH called the insurance company. The franchise. The person who own the franchise is actually the one that launched the investigation.
The person told DH that they will keep the discount although we did not do the class. I told DH that we will do the class online just to CYA. I don't want to be part of any scams or issues.
The person also told us that we should not talk to person A and B. Not to sign any document. And if we pick up the phone to tell them not to call us anymore. They had actually no idea about B being involved. Now, the fact that person B called us made the whole thing shift on him too while B could have be "safe" all along. A had no business calling us. A is now with another insurance company. Def. in HUGE trouble. Scam with classes and calling a competitor client.
So in another word, we were advised not to talk to them anymore. Which is fine with me. I don't want us to be involved in this investigation. All we wanted to know is where the money was when we called.
DH did not give them a copy yet of the letter we were asked to sign.
We do have a young child. We don't want people going postal on us because they are about to lose their licence. You never know what people are capable when pushed against the wall.
We were not even involved in the complaint in the first place.

Background.
An insurance agent (called A) was working with DH on our policy. Person mentioned the discount for the defensive driving class. But told DH, you don't need to go to the class. Just send the money, I will apply the discount to your policy.
Last week, DH called about discount. Found out person was no longer with agency (don't know the reason). Talked to another person and asked about discount. Person said, nothing was done. Money was not applied to our account. DH looked at check. It was cashed. Person said they would check it out and do an investigation. That they will also apply discount without having us do the class because of this inconvenience and where the money missing.
Two days ago, another person (called B) called me from the insurance but another agency located in another town. Told me discount was applied and we should see it shortly. Asked if DH could call IF he had questions.
Last night, B called and ask to talk to DH. DH is not available. B insists for alternate number. It irritates me. DH is not at his disposal. Goes into a weird twist. Start with saying that A was let go on the spot. That agent "owning" that agency has not clue on insurance, blah blah blah. That DH put in a complaint. That it would go against against A. That A wants to talk to him to explain what hapened. That DH needs to remove his complaint because the discount was applied anyway. So suddently, it becomes apparent that B is no longer looking just like a messenger but really just asking that the complaint against A be removed.
To which I call B on it. That the whole call is about this complaint. And how is B involved in this. B plays as being messenger again for A. A contacted B for a favor and wants to talk to DH.
Meanwhile, A is trying to call to. I see the caller ID.
Got really pi$$ed off on the phone with B. That maybe it did not occur to B that it was the actual insurance investigating and not my DH had nothing to do with it. That maybe B should mind his own business. When asked about his involvement with A, B says he can't say. B is really trying to bullying me. I yell at B for several minutes and tell B that I know this is just about the complaint. Not just asking about DH calling A.
So DH comes home. Calls A. A asks DH to sign a paper that he attended the class.
DH asks A why is B calling. A says that B is the person who was supposed to do the class.
I relay convo with B. How B was raising his voice at me. Trying to bully me. And it becomes very apparent that B lied to me, was bullying me and is completely involved in this. B was supposed to do that class but A told us we did not need to attend to get the discount.
Turns out DH never filed a complaint. Insurance is investigating. It has nothing to do with us. It was WAY above us and money was missing with other clients.
DH got a fax today from A aksing to sign that we know we took the class. We would be signing that we did attend the class and we did everything we were supposed to do.
HUGE RED FLAGS.
Told DH we are NOT signing anything. A is now with another agency. B lied to me about his relationship with A and the reason for his call.
We are just clients. We don't want to be involved in covering anyone's a$$ in a potential scam that was going on. Insurance has an open investigation.
WWYD???
- Show letter to insurance company? - DH tried to call B. I told DH to tell B to leave us alone. B is completely unprofessional and we will ot be involved in any cover up. We think B was involved in the whole thing too. That A's license might be in jeopardy. That B was also involved and potentially could be exposed. too.
I don't want anyone showing at my door with a gun.
We just wanted to have a $##@ insurance policy.

wow- thats some crazy story! I work for a company that has a defensive driver class and I know that if an agency is shown to have allowed people to not take the class but receive the discount- its BIG trouble with the state- but thats not your issue, its theirs
Definitely do not sign that paper. If they call, I would not talk to them at all- I would probably be nervous but I think I would hold that paper as collateral- you can tell them if they keep calling that the company filed the complaint but if they dont leave you alone you will contact the NY State Department of Insurance and the AG's office and send them that paper.

ummm wow!
i would certainly not sign anything, and document everything exactly as you did here with dates/times etc and definitely report it to your insurance company. Do it in writing.

I wouldn't sign anything & would EMAIL the insurance company about A & B and the call that you had.
I say email because then there is a trail. Calling can be miscontrued.

#1. Absolutely notifiy the insurance company and show them the letter. If they have an investigation going on regarding A, B or both, this is info they should have. It creates a paper trail which can only help you guys. It is also info that the agency investigating may need now that A is with a different company.
#2. Change insurance companies ASAP. Do not accept any more calls from A or B.
#3. Take the class. You can do it online and then you have nothing to worry about

Just curious, do you receive any type of paperwork showing you "took" the class even if you didn't actually show up for anything?
Is there anyway you can be in trouble for paying to get the discount without actually going to the class?

I don't think you can get in trouble... I think it's fraud on their part, not yours (although I am not an attorney so don't quote me ).

I don't know. That's why I was asking.
I don't know how this class works. Not sure if the agents get some kind of bonus or something to have their clients enrolled in this program.
It just seems everyone would just pay for the class without actually taking it if that was allowed. KWIM?
NOT saying you were wrong, it's just something "I" would be concerned about.

I have a few to offer.
As for as getting a discount without taking it. um NO!
Def seemed like a scam and how they are getting you involved its BS.
Some agencies have ppl who are qualified to teach the course. So maybe it was a way to get paid for it and "ACT" as if you were in class. Its fraud. Most companies also require a certificate, not a letter, to state that it was taken and filed.

Both A and B were perpetuating insurance fraud. I would call the home office of the company you use for insurance and insist on being switched to another franchise. I wouldn't sign anything and I would contact the NYS Dept of Insurance.

Agree 100% with Shamrock.
Doesn't matter where A & B are now. They are trying to cover their own behinds and make you and your DH complicit in their fraudulent activities.
Write up everything as you did before, and contact the home office of your insurance company and contact the state dept of insurance asap to cover yourselves.

If you are really fearful and have told them to stop calling (and they haven't stopped), call the police. You are clearly being harassed.

This comment worries me. Couldn't your DH get introuble too knowing he didn't take the class and is expecting a discount for just paying the money?
I know this whole thing is crazy and it sucks you have to go through it, but Caller A told him to send in the money and he will just apply the discount. Why would an insurance company do that? I would have questioned it at that moment.
