I guess i am in a minority here as well..but if the lesson had not started yet, I think its your responsibility as a parent to have your kids right beside you until it officially begins.
That isn't to say things couldn't have been handled better on their part...I agree with you there...
But..I just don't know. I can't see getting anyone in trouble over this. Especially when a child is just beginning to learn to swim. If this happened after the lesson started its a different story...just my opinion. I'm sorry you went through that though, very scary...

I'm sorry, but if there is a lifeguard on duty, it is THEIR responsibility to keep their eyes on the people in the pool. I don't care if you were standing right there with your eyes on your DD...it is still HER responsibility as the paid, trained professional! I would also demand a refund for my unused lessons and would want to go elsewhere. I also agree with the person you spoke to from Suffolk County who said that if you got there first, they were too far away. Jumping to her feet the first time your DD went under is not enough...she should have jumped INTO the water!! I'd be fuming!!
And for the record, this DID happen to me. When my DD was 1, we were in a kiddie pool in NJ. There were NO other children in the pool but mine. And I was IN the water with her...walking RIGHT behind her. I looked away for a split second and my DD went under. I looked down and she was SINKING to the bottom of the 18" of water!! I grabbed her up, etc... I was pizzed at myself for looking away, but I was more pizzed at the lifeguard for doing NOTHING; he didn't even ask if she was okay! So I know how you feel, and I wished I had done something at the time for the lifeguard's inattentiveness.
I'm sorry...they are being paid to GUARD LIVES!!
