Employment at Will Contracts?

The company I work for is being sold next week...Friday is supposed to be the closing...

Today, we got a 14 page employment at will contract to sign. We were told we have til the 30th to return it, in case we need an attorney to look at it, etc.

I have never seen or signed one of these before. Anything I should look for? I don't want to have to hire an attorney to look at it either...

Not sure what to do here. Any tips?

You are not in NY, right? B/c I believe NY is an at will state, so I don't know that many people on here can really help

Re: Employment at Will Contracts?

In short, an AT WILL contract is to tell you that they can decide to let you go at anytime for ANY reason or NO reason.

The same goes for you. You can leave your job just because.

More and more companies/States are doing this.

If you want me to take a look at it, FM me. I can look at it on the train. I'm not an attorney but have a lot of experience with employment contracts being in HR.

As far as I know Montana is the only state where there are probationary periods required. Other than that every state would be an employment-at-will state.

The non compete clause is different from the at will. You have to be VERY careful with a no compete clause. Because that could mean you cannot work within a certain mileage of the company you work now.

The non compete should state for how long you cannnot compete. The distance you are not allowed to compete from their company, etc... It usually takes effect after you leave the company.

For example I have a 10 miles non compete zone. But I work in a different county so I could still find work closer to my house or in another direction. I have had a 6 month non compete zone for a 5 mile radius in the past with another work.

The non compete clause is very important for you to look at. That could mean you cannot work in a company where you want to go work for. I have negociated no compete clause before. I usually reduce the radius miles I cannot work in and the time frame.
