Amen! Totally disgusting. And it is rape when the person you are having sex with is blacking out and cannot consent.

I still can't believe the pure stupidity here. That one cop had almost 20 years- he was THIS close to getting his pension. And he throws it all away. All those years of work- for what? What a loser....

I'm glad this guy was fired. I still don't understand how a woman so drunk can legally give consent- but the law is the law. But it is utterly disgusting, morally wrong and should be illegal for a cop to take advantage of a drunk woman he was called in to protect. CLearly this man is a predator and deserves to be fired.
Hopefully his wife will kcik him out and he will learn the full consequences on taking advantage of a drunk woman you are supposed to be protecting.

Well the Post is saying the cops are fired so at least there was that justice.
I agree that it is very hard to prove that there was sex in this case even though I beleive they did it.
It wasn't hard to prove there was sex. She had a recording of him saying there was sex and that he wore a condom.
Firing them doesn't = justice in my eyes. He took advantage of this woman. He should be in prison and treated like the criminal & predator he is.

Moreno lawyers have said just because Moreno said there was sex and he wore a condom doesn't mean there was sex Saying Moreno only told her that because he didn't want her going into the precinct and cause a scene Since there was no DNA evidence....there was no sex...no sex...no rape.

Actually, the DA's office set up a wire (which in my experience means they really had doubts about this case) and sent her to his precinct. He denied having sex with her 24 times before he finally said he did - most likely to get her out of there. Horrible evidence by the DA and it backfired. Very hard to find a defendant guilty based on this subsection of rape.

well, I will say that it looks like the jury took it serious, analyzing the evidence they had - 6+ days is a long time! (although the longer deliberation, the more likely an acquittal, I believe)
I am happy that Bloomberg/Kelly made the right decision! At least there was some kind of consequence.
Yes, I guess ultimately it is the decision of the Commissioner, but it really doesn't matter what Bloomberg thinks. They both violated regulations in the NYPD Patrol Guide - whether or not they were convicted of the misdemeanor or not, they could've been fired anyway, being convicted just made the process a little easier. They admitted under oath to several things that are direct PG violations.
(My DH is studying for the Sgts exam now, I hear WAAY too much about the Patrol Guide lately).
