When you purchased your house a survey was supposed to have been done. It should show you where your property line is, what trees and bushes are yours and where fences lie as well.
We have a fence along the back of our yard. It is 100% on the other persons property. The fence is theirs (the good side is facing us) yet we still replaced a few sections when we first moved in becuase they weren't doing it, and the fence kept falling into our yard !!
so sometimes despite whose fence it may be, doesn't always hold true for who is doing what for the maintance of the fence.

I could be REALLY wrong here.. but my friend told me that if the 'ugly side' is facing your property, it is your fence regardless of who purchased it. Could be TOTALLY incorrect but I figured I'd throw it out there and see if anyone else knew anything like that..

We checked the survey and our old fence (was only on one side and linked to the neighbors behind us) was literally on the property line. We asked our next door neighbor and he had no idea who it belonged to either, so we asked if he wanted us to leave it or have it taken down when we put up the new one (the fencing company did this for free) and he opted to take it down (it was an ugly old chain link, I don't blame him!)
