Any way to break a lease in an apartment complex/?
I am so fed up with the complex we live in. I would love to get out now. We have about 6 months left though. Is there any way out??? Please tell me there is!

it depends on what is making your situation unbearable. you have a right to a certain quality of life. what are your grievances?

Nothing that directly hinders my quality of life. It is the lack of communication and orginization of the management company. No one ever calls me back or responds to my grievances, ever. The dealing with the snow removal was horrendous. I called dozens of times asking where there maitenence crew was to plow or shovel. The complex has their own plows. I finally threatened to call News 12. They finally came. As I said before, I leave messages with the receptionist constantly. Everyone is ALWAYS busy and will call me back. No one ever does.

What is the management company? I know a lot fo their policies.
Typically you would need to pay a Lease Break Fee. That would have been outlined in your lease. Usually this is a two-month rent fee. However, if it is not outlined in your lease, you can just give them notice that you are moving, give them a date. They will then try to re-rent your apartment. . If they rent it, it is illegal for them to collect rent from two different parties on the same unit. SO, you would only be responsible to pay rent until the day before the new tenant moves in. As long as they they don't call it a Lease Break FEE..once they call it a fee..you are responsible.
You would also run the risk of the unit not renting..then you could wind up being responsible for even more than two months.

people don't realize it but anyone can break a lease AND get your security deposit back. i sent a letter to my management company with enough notice that i was leaving and require my security deposit back at a certain time. they didnt fight me.

I do not see a break lease fee any where in the lease.
Then you should go in and give them a date that you are moving. Give them 30 days notice..unless lease states otherwise. (Technically you only have to give 30 days) Then see what they say. There could be something that you are missing.
I remember I had a friend who emailed me her entire lease, she lived there, and was trying to get out of her lease too.

You are very lucky! It is very unusual for this to happen. Usually with Month to Month leases you will see this. And trust me..not anyone can do this. I have seen many people get so screwed by leaving without any notice..credit, and otherwise. It can make it very hard to ever try to move into another community, or buy a house for that matter.
Also, when you screw them..they can keep your security deposit, and it is very legal. Sounds like you had a really good relationship with them!

nope! my friend worked for the marshalls office in brooklyn and wrote the letter for me.

maybe its because i gave enough notice? i would never just leave without notice. my friend who worked for the marshalls office helped a lot of our friends do this and no one had a problem.

maybe its because i gave enough notice? i would never just leave without notice. my friend who worked for the marshalls office helped a lot of our friends do this and no one had a problem.
Could be, maybe they were full, and knew they could rent your unit. Maybe they just liked you, and you had a good relationship:) Worked out in your favor. Especially leaving before your lease ends..that always holds up in court...regardless of how much notice you give.

I manage an apartment complex....right down the road from where you are. To the PP you are very lucky they were kind because by law they didn't have to give you diddly squat, keep your security, and take you to court to re-coup any fees lost for the time they could not re-rent your apartment.
I know here if I have good relationships with my tenants I will allow them to break their lease but I keep their security.
At Fairfield.....you might as well give up your newborn child.
I would call the office manager and ask the lease breaking policy...Good luck

We were able to break our lease when we relocated to CT with no penalties and we got our security back. We did have to show proof we were relocating. We were only a few months into our new lease when we were moving.

I would like to write a letter expressing why I would like to get out of my lease. any idea what to write?? I clearly cant write bc I hate the management. if I write we cant afford it anymore how can I word it?? thanks

I wouldn't even give them a reason. If you signed a year lease and there are not any allowable reasons in the agreement then no matter what you tell them will not get you out of the lease free and clear.

I would no way write that you cannot afford it. Things can home back to haunt you if you put that in writing.

I got out of mine a few years ago by telling them that we had come into a financial hardship and were moving in with family.
We gave them 30 days notice. They did not ask us for proof and they did not give us a hard time about it either.
I know they were not full because they were running specials to get more renters. The only appeal our unit had was it was the 2nd floor and when they found a new tenant they could get more then what we were paying (we got a deal on it because I caught an error in the contract when we went to sign the lease)!
We did get our deposit back, it took a little longer then it should have but we got it.

Well, technically, unless they officially release you from your lease they can just let the apartment sit vacant for the remainder of your lease and then sue you for the rent for each month left.

whomever told you that is wrong... in some states that is the case, but in NY there is no duty to mitigate.
