Any idea what to do in this situation - renting apt move in issue

Any idea what to do in this situation - renting apt move in issue
I did a walk through after renovations were done, took pics etc to document for the security deposit, but we were missing the stove when we did it (the wrong one was delivered and didn't fit).
They actually do move pretty quickly with renos like that, you'd be surprised. They had ours done in time under a similar deadline. It's not fit for habitation without a working toilet or sink. I would expect them to prorate the rent but it won't take them 2 weeks to do it. And I wouldn't want to do the official walk through until it was all done, what if they damage or break something when finishing up?

tnx. exactly, there is no basic needs service. I wrote to them and told them that I will prorate for each day those items aren't finished and the apt cannot service basic human needs. was just wondering if they try to argue with me what are my rights as I do continue living in the old apt (but paying higher rent )

I would pay your current rent not the new rent and when the new apartment is ready for occupancy have them do an amendment to the move in date.

This.
I do housing location in my "spare" time and most of the time, the client doesn't move in when they are supposed to, so the mgmt. just amends the lease.
It's stressful for the tenant, but it's also pretty common and not anything to get yourself worked up into a tizzy over.
The landlord is still getting paid.

If you signed a lease for the higher rent starting Jan 1 then you have to pay that. If you talk to them, they might prorate you the days that the apt is not finished.
However, my bet is that the apt will be done by the end of the week and it might not be worth your time to fight over a few dollars. Our last apt was completely gutted and redone (sounds similar to yours) in under a week. Any apt complex usually has a staff or company that does this all day every day. They have the materials ready and just have to do the work, which is just a few hours with a couple of guys.

I run into a maintenance guy just now. Who said they will be working well into this week including this Sat. And for the record they been renovating for the past 3 weeks at least.
But the issue here is not the money, the issue is that they made us sign the contract for 1/1/14 when we wanted 2/1/14 and they told us over email the apt will be fully finished and ready for move in and in order to sweeten the deal they are giving us 2 weeks to move. Now the move period is shortening obviously and we are paying a higher rent.
As a PP suggested I will have them just adjust the contract not to be from 1/1 but from a date the apt is finished and will prorate Feb rent as I already given them an official notice I will de doing that.
