I am so angry and have to vent!!
Some lady just dented the whole front quarter panel of my truck by crushing a shopping cart between the cars in the Target parking lot.
When I tried to get her attention she almost ran me down to get away. Some other woman saw her do it and followed her, tried to get her to pull over and she almost ran this woman down also.
And, the cop comes - I give him all the info (got the plate #, etc.) and he tells me it is a property damage case - he can't file it as a hit and run because there is no paint on my truck and she didn't actually hit my truck, she hit the cart.....so all I can do is pay whatever it costs and then try to get the $$ back through small claims court. As if that's going to happen. And as if I have the $$ to fix it right now with the holidays coming.
I am so beyond pizzed right now it's not even funny.

I wonder if that really is the case though, what the cop told you. It sounds wrong, I wonder if there is a way you could actually look up the law.

DH is a CO and I have a few friends who are cops. I don't think the cop was wrong...but I'm going to ask around about it.

I figured as much...I assume that since the police are trained in all the laws and codes that his info was correct.
I just hate that this ****** is going to get away with what she did...

don't the signs in the parking lot say to return the cart to keep the costs down for the store?
I would speak to the Manager at Target and ask them to pay for it- they must have insurace for that right??????
and I would totall sue her - what a JERK

Sorry that happened to you. People can be so rude and irresponsible.
You can still go through your insurance. Give them the facts of what happened and the license plate from the other car (and the witness' information if you have it) - they will still be able to subrogate for the money against the other carrier. Or, run her plate and file the claim directly with her carrier. She is the proximate cause of the loss and should still be responsible. Good luck whatever you decide.

Gerty - can you ask the manager if they have a video camera in the parking lot? Maybe if you have it on video you can prove it and have a better chance of seeing payment? 
Sorry that happened to you. We just got our car back yesterday from the deer hitting it and our 'little fender bender' cost over $5,000!  
She should have to pay- not to mention getting a ticket or leaving the scene and almost running someone over! I know it's frustrating- but I'm glad you're ok!

id definately try for this... althought its going to be a bit difficult if you dont have the witness info to back your story up.
it definately sounds like a proximate cause case

Oh that's MESSED UP! I'd definitely still call the insurance company and see if they'll try to hold her responsible.
But regardless, that is really unfair.

Do you have her license plate number? There is a chance that you can still sue her civilly--for property damage. Talk to a lawyer who specializes in that. If you can sue her, I'd contact her & let her know that you're planning on suing. What a little creep, trying to run away!

Try to go through the insurance co. A few years ago this car ran into a street light & it fell onto my car, damaging the trunk. The insurance co paid for everything.

Damn Gerty, I'm sorry.
While I do think that karma works in that - if you're that much of an idiot - sooner or later someone's gonna call you on it... I would do everything in my power to make her pay. Somehow.
I'm glad you're ok and that it wasn't too serious of an accident. People like that make me wonder how often they do that and get away with it.
