I'm curious..for those that switched from oil to gas..if your tank was in the ground what did you do with it?
We bought our current house knowing they switched from oil to gas and that the tank was filled with sand. They filed paper work with the town and it wasn't an issue.
We are selling and are under contract with our now and the buyers wanted us to take it out because there lawyer told them to walk away if we didn't. After we heard that I spoke to a few of my friends and 2 other people said they walked away from in ground tanks.
We took it out and we are very fortunate that everything worked out in our favor.
So for those that converted what did you end up doing with your tank?

if the paperwork is filed with the town why would the lawyer make an issue of it?
I haven't had anyone walk away over a properly abandoned tank
I feel like lawyers can hinder deals rather then get them closed sometimes

That is strange...when we bought our house we had the owners legally abandon and the tank is still in the ground...if we ever sell it wont be a problem since its legally abandoned...they put in a new above ground tank that the boiler company that we used to convert took away

We thought it was really strange too. Actually both my agent and the buyers agent also said it wasn't a big since all the papers were filed and we had a certificate of approval.
The fire inspector that came out for our permit said that he is seeing a lot of this and he thinks it is the attorneys too.

ours was properly abandoned but still in the ground. As long as I saw all the paperwork and it was filed with the town we were good to go.

We had a first offer on a home that had MAJOR issues with the underground oil tank. So we knew after we lost that house what to look for. We are currently under contract with a home that was converted to gas by the prior prior owner. The current owner has all the paperwork and even said he would have never bought the house if the sellers at the time wouldn't provide the permits and proof that it was abandoned properly.
DH and I wouldn't see the need to ask the sellers to remove a tank that was proven to be properly abandoned.

Proper abandonment should be filed with the EPA. As long as its abandoned properly then it shouldn't be an issue?
