We got an email that due to the court ruling, masks are optional. This leads me to believe masks cannot legally be enforced in a public school. My district would never lift a restriction unless their lawyers told them they had no choice.

Every child and teacher I saw at drop off was wearing a mask.



All districts in Rockland got an email that due to the appeal, masks are still mandatory. It's being questioned left and right though so we shall see.

Our district sent my friend's daughter home (in K) for not masking (ok, so obviously it was my friend making a statement).



Interesting! I’m so curious as to what drove the decision and the legality on both sides.



They just re-stated what the state had said - they are appealing so masks must be worn... I don't think what they did was actually legal though, as the stay hasn't been filed yet (that is going to court at 2pm from what I've read).

This is from a lawyer who has been assisting parents in our district with various lawsuits due to medical exemptions not being accepted, and other legal issues these draconian measures have brought up.

Here is what he has said today:

There is a valid court Order issued by a New York State Supreme Court Judge.
There is NO stay in place. You would have to go to the appellate division and and file an emergency motion for a stay with notice.
If your Superintendent or School Board are NOT following the court order, they are in contempt of Court.
You can file an action to hold them all personally in contempt of Court.


ETA- my friend from another district in Nassau who's district didn't lift the mask requirement last night just texted me that she finally got updated guidance just now and her district admitted they did not have legal authority to require masks until a stay is actually granted by the court of appeals. So no masks for them tomorrow.

If her superintendent or principal are not following the order, she can file a contempt action against them personally.
If the governor ordered school districts not to comply, she is also in contempt of court and should be held accountable.

The CHILDREN are muzzled
The adults, including our dictator Governor who is fighting tooth and nail to undo the Supreme Court ruling as we speak is not.

Nice, right?
Our kids have to protect the adults.
What a time to be alive!

Because we live in a world where our children have to protect the paranoid adults.
This will be read about in history books and the brainwashing and psychosis that was so easy to perpetrate will be studied in psychology texts.

My district released the mandate. I gave my kids the choice this morning and they did not want to wear it. Can't say I blame them. I'm just surprised this is happening during a spike. In the spring when the numbers are down, I get it, but now the timing is just bizarre.

When I did drop off, I noticed staff was wearing them but the kids were not.

As an attorney, I feel like this is like a legal super bowl. The order is well written and supported. I am definitely interested to see how this goes in the 2nd Department and then, what I anticipate will happen, at the Court of Appeals. Regardless of my personal views, I could never understand how any of these mandates were constitutional once the emergency was over (decreased death and hospitalization rates). I was particularly appalled by the vax mandate and thought it was a huge abuse of executive power. I am really interested to see how this plays out in court.

Except if you work in NYC. Then you still have to be vaccinated to work in a private business.

NYC- the law of the land does not apply there!

When they appeal it the stay should remain until a decision is reached on the appeal. Prohibitory stays like this one remain in place until new appeal is ruled on.

As a lawyer can you answer this if the original order that was issued yesterday stays in effect can a public school choose to keep masks mandatory if they wanted too?
Because no one seems to be able to give a clear answer on this


Also you say that you thought It was abuse of executive power to have a vaccine mandate but we have vaccine mandates now so do you feel like that for all mandates or just the Covid one? Why was it ok for the other ones to be mandated and not this one. Regarding the law (I know people are going jump on and say you’re not anti-vaccine just this one I get that)
