Yep. It's not up to the superintendents, the BOE, etc.
Unfortunately it is up to the schools all the ruling means is that the governor can’t mandated but that does not mean that schools an individual businesses scant say they want you to wear a mask!

No masks required in schools in Nassau County
I’m excited about this… but I wonder what will happen with quarantine…. I’m afraid that if a kid tests positive then it’s back to mass quarantining the whole classes. Right now they don’t do that because everyone wears a mask and it’s only the sick kid …. That’s going to be interesting

Yes it’s going to be a nightmare for the schools. Especially since parents don’t understand that the school still can mandate it.
Also they already stated an appeal will be filed which means the original mandate will be still in effect.

I did ask my school when we first were allowed to have masks optional till it was quickly overturned lol and yes quarantine rules at least in august we’re definitely more kids will have to be quarantined if masks are not worn by all. Which will suck if it’s still true!!

This is indeed great news! It was about time that woman was stopped. Although the DOH already said they’ll appeal and Hochul said she strongly disagrees with the ruling and will be pursuing every option to reverse it. There are still some districts that are saying they don’t have the “authority” to remove the mandate which makes me think it might be because they’re still reviewing the court decision? Although the ruling was pretty clear, it says schools and public locations. But I do believe parents should even press those districts harder now that these mandates are illegal as per this SC judge.

Also they already stated an appeal will be filed which means the original mandate will be still in effect. . I don’t think so because a stay was issued. Stay will be in effect unless a different judge lifts the order.

Lmao. Unreal. Well listen, I'll take every maskless second I can get for my child. And even if it takes awhile and goes back and forth, we are at least moving. Freedom isn't free. I'm willing to hold on for the ride, but I'm just glad we are seeing movement. I'll celebrate every small victory until we can hopefully celebrate the big ones!

I really hate how they announce these things after business hours as we can never get a straight answer.
It is true that if the Governor sends in an appeal that the current mandate would be still in effect until the courts hear it, but I don't know if she could actually put in an appeal because she had no authority to issue the mandate anyway. We are not in a state of emergency and she does not have the power for emergency executive orders.
While I am very happy masks are on the way out, I also feel terrible for the teachers and administrators tomorrow. It's going to be a shit show.
Our district is still mandating the masks but Facebook is blowing up and parents are storming the schools tomorrow to make sure the kids do not need to wear them. Secondary kids are just going to rip them off as well but they never wear them correctly anyway.
