Please help! for anyone in HR, payroll or any (tax)accountants
Dh and I closed on our house in Suffolk 5/26/11...moved in a few weeks later, in June. Basically since that point, I have been trying to have NYCity tax stop being taken out of my check (used to live in Queens).
I work for a huge company...the HR department has given me wrong information constantly (and bounced me between them and ADP Payroll more times than I can count), given me wrong forms including forms that apply to other localities (not even in new york), then forms that indicate that city should begin to be taken out, and the list goes on.......finally, I contacted the IRS directly, because i thought they could tell me the correct form and secondly, i need to know how to get my city tax back, by now, its almost $1,000 for 2011 and still going up.
They said that the company really should stop taking the money, and file to give it back (in the same tax year) but if they give me trouble or it changes tax year, that i could just make out an extra form when i file my taxes to get the overpayment back. Plus, they told me the correct form, I had to tell my HR department and ADP Payroll that I am submitting this form as per the IRS...I submitted the form, its a month later, taxes are still being taken out. I don't know what to do at this point...I have to fight for my own freakin money which is noones to take in the first place!! Im so frustrated and have no idea how to get this taken care of!
Can anyone please help???

Not an accountant but when i moved out of the city i filled out a new w4 form(like you do when you first start working) with my new address. They stopped taking city tax. Then when i filed my taxes, i filed as a partial city resident and I recieved a refund for the extra that was taken(took them a few weeks to stop taking city tax). I would find out exactly who is charge of payroll and speak to them. Send them emails and follow up till they stop. The good thing is that when you file your taxes you will get everything owed to you back. Good luck

I think you need to fill out a new w-4 to change the with holdings.
I moved to PA but still worked in NY and HR had me fill out new w-4's. They do however have to take out state tax.

It should be a simple process to change. Have no idea why they are giving you such a hard time.
Definitely fill out a new W-4 firm and hopefully that works.
In the meantime, when you file your taxes, this withholding will be reported on your NYS tax return and pending on your overall tax situation you should get that money back.
Don't let them get away with saying they have to withhold city tax because you work in the city. Since you are now a Suffolk resident you don't have to have city withholding.

There is also a NYS state that can and should be completed.

I work in HR and do payroll...I can't believe they are giving you a hard time. Our employees have to fill out a change of address form and if they moved outside the city we just remove the nyc local taxes on the next scheduled payroll date. FYI ADP is the worse for customer service. You might need to fill out a new IT-2104 form.
