The suit also names the Department of Education for failing to police the 'improper conduct' of its employee, according to the New York Daily News.

Typical BS. They are just looking for a payday and the suit is a bunch of garbage. Not saying she didn't take advantage of her student, but how is the City of NY and the Dept of Education to blame for that? How do you police "improper conduct" if she is having sexual relations with him in her car away from school?
If the dept of Ed and the school did not know about the affair, they can't "police" it. The parents of this kid just want to get paid and after it's all said and done I imagine they will wind up settling for $30-40K at most.

I know she's not innocent but come on. That kid was probably having time of his life - even though I have heard studies where it has an impact on them later

Ehh, if it was a male teacher and female student, I think less eyebrows would be raised. It's NOT the entire BOE's fault but maybe will get them to better monitor what's happening in schools (wasn't there another recent story talked about on here where an elementary teacher was molesting students IN school, in their classroom). Or set up a better system of checking up on teachers...
I don't know what the right answer is but I can't say I wouldn't do the same thing.

IMO, they're not.
They had no knowledge of what was going on but they have the money.
This family isn't going to get all that coin from snickers so they're going after those that can foot the bill.
It's bull shit. A waste of our courts time and resources and tax payer dollars.
ETA: And yes, I'd say this if the roles were reversed. This young man wasn't traumatized, he was getting it on with his young (and seemingly hot ) teacher.
If you ask me, if they get a settlement of any kind this kid has struck gold twice.

Isn't it a little strange that she is saying the doe should have policed the teacher better after work was over but the mom obviously didn't do her job watching her son after school hours..on her own watch. Not saying the teacher was right but its not the does job to monitor everything a teacher does outside of school hours so how are they at fault?

You are bound by what you claim in your complaint. So if you claim $10, you can only get $10. No one actually thinks they will get $10 million.

Was anyone tutored one on one with a male teacher? Is that something that would cause you concern?
I have been thinking. I haven't. I did have a math teacher tutor us after school some days and it was usually in a group.

He's the reason I passed my chemistry regent with flying colors.
Great, great teacher, and he was NEVER remotely inappropriate.

The DOE is known to settle in most cases to avoid court, BS but could happen that they get a payday from the DOE

The doe may be held responsible partially. I would guess the mom would agrur that there is the expectation that when she sends her son to school he would be safe.
And yes 10 million is a lot but it is a negotiation. Start high so you will still end up with a decent amount. Legal 101!!!

My guess is no and I don't know how the union would work into this.
The only time I have heard of personal responsibility while being a teacher is when a science teacher did not follow safety policies and then a student was harmed. And even then it's pretty iffy (who is held responsible). As a former chemistry teacher that definitely scared me.
It's too bad teachers like this ruin it for others. Just like any profession there are good and bad apples. From personal experience, I've seen some teachers do stuff that I can't believe is just looked over...this doesn't bode well with me now as a parent.

My husband tutors students 1:1, but it is always at the student's houses (with parents present) or at the library.
