WWYD Neighbor Fence Issue (long)

My neighbor's fence is against code- it is placed too close to the road (there is no sidewalk on our side of the street). We live on a street with a double yellow line that is busy in the summertime.

I could care less that the fence is against code, the issue is that there is a Japanese maple planted right in the corner. When we moved in 3 years ago, it was the same height of the fence (3 feet). Now it's a good two feet above the fence. The leaves are very dense and it's impossible to see through.

It's right next to my driveway and creates a major blind spot when I'm pulling out of my driveway- I can't see anything until I'm already halfway in the road- with my DD in the backseat. It's become a serious safety hazard because people can't see me pulling out either.

We have a good relationship with this neighbor. We spoke to him about it in the fall, right before I had my DD and he said he would move it. It was a pleasant conversation (I never mentioned the fact that I know its' against code, etc.). He never moved it. This spring, I brought it up again, and asked him if he would just pull in to my driveway and pull out so he can see how hazardous it is. He never pulled in and out so he can't see just how bad it is- I feel like he thinks we're making it up or something. For the second time, he told me he'd move it and never did. It's now 9 months past our original conversation and nothing has happened.

My DH was working on our roof and the neighbor was his yard with his company. He did not see DH and was talking about us, showing them the tree and saying it's worth $8,000 (which it's not), and how he has to move it because of us. I'm really starting to resent this guy for putting my DD in danger every time I pull out of my driveway.

I agree. You did the neighborly thing and asked TWICE for him to take care of it.

he isn't respecting your request (after he said he would)
And IMO there is no reason to put your life or your DD at risk because of a tree, 8k or not!!

You did the "neighborly" thing twice. Twice he humored you and said he would take care of it. It's obvious he has no intention of doing so.

Call the town.....

call the town. it's worth your safety & your families. you did the right thing twice and he couldn't try to help out.

Thanks ladies. I had a feeling that calling the town would be the general consensus. I had hoped that he would just do what he said he was going to do, but it looks like that's the route I'm going to have to go.
