Was I really nasty? UPDATE
Well, it got worse as the day progressed - much worse. So I forwarded all the emails to HR and I got a call from the head HR guy in headquarters - we're going to talk at length tomorrow about writing him up, which means, if it ever happens again, automatic dismissal.
------------------------------------------- One of my team members is accusing me of race discrimination and that my tone is too harsh. Much of these accusations are merely a mask for his own work performance issues,which are dreadful.
He is absolutely HORRID with meeting deadlines, and missed 10 deadlines I imposed on him last year.
Recently I imposed a deadline of 11/12 for another work product. He asked for an extension until 11/16, which I granted. He again asked for an extension until 11/22, which I granted.
He just informed me today that he won't have it for me until tomorrow. This was my response:
"Ok, but as this is the third extension that I have accepted, I will not be able to provide any more extensions, and expect the letter to be submitted by COB today. Thanks, Beth"
He just sent me an email stating:
"No need to be nasty about it; I said I’ll get it to you."
Your thoughts? Was I nasty? Was his response appropriate? How would you respond?

nope, you were clear and stating the facts. sounds like there are some big job performance issues with him.
might be time to have a meeting to discuss his job duties, work load, etc, and offer him some training perhaps if he's unable to meet the work requirement. and if he's accusing you of discrimination, i'd loop in your employment counsel and hr folks pronto.

I dont htink you were nasty--I am in HR and sounds like a conversation is needed. The thing about emails is they can be interpreted the wrong way or the person can invoke the wrong tone of "voice" in which the email was meant.
Since he is talking race definitely at least inform HR.

Yup, I've done all that. I have bi-weekly meetings to discuss his work because of the performance issues I've identified. I send him extensive feedback on all of his documents, I've notified him at least 10 times in the past 10 months of my concerns about his performance issues, and identify specific examples. I've offered EXTENSIVE legal writing and analysis training, which he has rejected, or when he accepted once, he canceled the appointment, and I've had meetings with HR and my supervisors to cover my back for every communication I send to him.
It's just that, after a while, if you're bombarded with accusations of harassment/discrimination, eventually it starts to whiddle away at you and you start to question whether the accusations are actually true.

Ok, just did. The only problem is that our HR guy is just so incredibly unhelpful. I'll send to him and will CC the HR rep in headquarters as well, asking for some input on how to respond without causing WW3

You were not nasty. You were blunt - which is exactly what you should have been.
I agree that he's being insubordinate. He's also setting the agency up for a lawsuit so I'm hoping that you're documenting your extensions & what's acceptable & what's not.
I would wait for HR's response on it.
Also he stated you would get it to you by tomorrow in his last email. Telling you he said he'd "get it to you" in a follow up email, doesn't mean that he'll comply by your deadline.

Beth, you know how hard it is to get someone moved/fired/transferred in the fed.
hr's hands are usually tied anyway.

Yes, I'm documenting everything. Unfortunately, in the federal government, it takes nothing short of a miracle to get rid of someone, so I have to find a way to work with him, while he files litigation against me.

Your email was direct and to the point, which was completely appropriate considering the situation.
His response sounds like he's trying to cause a back and forth banter with you. Hoping you will say something discriminatory or out of line which can add to his non existent case.
I agree with the PP, inform HR of what's going on. Even if they do nothing, or it's going to take a long time...just make it known that this is going on.

Dont even question what you said. What you said was direct and to the point. not even a little harsh. What does he need Mr. Rogers as his boss? Too bad. This is his 3rd extension, if its not on your desk by Monday I'd have him written up and fired. No need for 3 extensions...thats ridiculous. He needs to grow up and get his work in on time. adding-I'd probably write back something like "thank you for taking the time to read my email. i will be expecting your work Monday AM at 9am."

He was not only nasty, but sounded immature and extremely unprofessional. You did the right thing by forwarding it to HR. You were much too nice offering him the 3rd extension.

Unfortunately, people use discrimination as a an excuse for poor performance all the time......another good one is when all of a sudden they have a 'disability'
Good luck - HR should be able to help you!
By no means did my comment mean anything against someone with a legit disability - just working in HR for 10 years, you see a lot of BS!
