Any NYC Teachers Who Gave Birth Over The Summer?
I have questions please....
1. How true is it that IF you give birth over the summer your FMLA(if you take it) doesn't start until September? Also, if that be the case is it true now we can do 16 weeks keeping our benefits, not just 12? So, could this potentially take me to after the x- mas break to return without losing benefits?
2. Is it true if you work til end May you get full summer pay even if you take off in June without pay?
Just to note I have no days in bank. Borrowed my 20 when I has my DD over five years ago and never earned any back. Id like to take off several months but keep benefits, don't want to deal with losing them and then having the struggle to get them back. I am due July 29th and know it'll be a C-section.

I know FMLA runs concurrently with maternity but I have read several older posts on here and also saw in some other NYC Teacher discussion boards that IF you give birth over the summer it doesn't start til school begins. I have to find out the definitive answer from somewhere although we all know how tough that is.

You are wrong. I does start the first day we are to report to work (so those conference days are day 1 of your fmla. We are not working over the summer so fmla can not start. My friend/coworker had her baby in july and just did this.
I had my 2 babies in my and both times my fmla stopped over the summer and finished the remaining weeks whe. School started again
Im not sure about the 16 weeks, i know welfare fund is extended 6 months after, you just beed to apply to get the extension

I don't think I'm wrong, I went to the UFT workshop and experienced this first hand with coworkers.

I hope this is true. Is your friend a NYC teacher? Any chance I can contact her in some way since I am due also in July? Id love to talk to someone.
Ps. So frustrating, even my payroll secretary doesn't know this. She's like I "think" FMLA starts(even with a summer baby) as soon as you give birth.

Yes she is nyc and so am I
Ds #1 born 5/30 i took off all of june that was 4 weeks. In september i used the remaining 8 weeks and stayed out till november (then took the year off)
Ds#2 born 5/3/13 used like 7 weeks and had 5 more weeks to use. Took another yr off though.
But my friend with the july baby and another with an august baby (2013) took 12 weeks starting september and 12 weeks were ending told proncipal they were taking the yr. so yes you will get 12 weeks. However they will be unpaid
You can sign up for the workshop. I went and its very informative. You cant go until a couple months before you are due bc she puts you in the workshop with other preggos wbo are due around the same time so all the info applys to everyone.

You will get paid but they WILL ask for some Money back so be prepared (unless you have enough sick days, which you do not) They will ask for June checks back and prob summer.
If you work til end of may you will have only about 8 weeks left once sept starts.
Honestly i would not do this i would work til last day of school so that you will not have to pay them any money back and will get full summer pay. You will also then be able to take 12 weeks at the beginning of the school year

Thanks a million, now how the heck do I undermine my payroll secretary and tell her she's wrong? Would you believe she said nobody in my school ever took a FMLA leave? I am in this school for two years, was in a different school 5 years ago when I took FMLA. How is that possible? I would think many take FMLA to stay out extra time and hold onto their benefits, no? Your principal has to let you back whatever time of year it is when FMLA is up, right?

Any NYC Teachers Who Gave Birth Over The Summer?
I had both of my children in July. I work for the DOE. I worked until the end of June both times. FMLA 100% starts in Sept. I haven't heard of any time allowed past the 12 weeks, unless your doctor will write you a note about a medical condition, which would make it impossible for you to work. You have to file with the city and wait for approval. Your next summer's checks will be significantly decreased, but its worth it! CONGRATS.
