NYC teachers - childcare leave questions?

I'm currently out on a childcare leave with my DD, born in November. I'm trying to decide if I want to take another year off. I have 6 years in the DOE. I work in a small school in Queens and was the only guidance counselor.

My principal hired an ATR with a year or two less experience than I have to replace me. I know if I go back to work in Sept., I get my job back. If I opt to take another year off, do I still have that right? Or can my replacement bump me and send me into ATR limbo?

You have the right of return and if they have less time than you, you bump them out

im a guidance counselor too and going through something similar... but im not in NYC schools.

I have been going back and forth with my HR person and union rep. It' s not part of the teachers contract, but rather a labor law that once you are at an unpaid status (after your 6 or 8 weeks) you no longer have time towards service in the district/retirement. As long as you go back when you still have more "time" than the person less senior than you, you are ok. I am planning on going back with about one month leeway. You should also check if she was hired on letter contract or sub contract. if she is only a provisional employee, not permanent, I don't know if she could still bump you.

R- I emailed the head UFT for guidance (Rosemarie Thompson). SHe did not even write back, but had someone contact me for a maternity workshop Chat Icon

The man I spoke to from UFT said "whatever the rule is it does not change from 1-4 yrs" so I think that means if you were told you would get your seat back after one, you would get it back after two yrs leave just the same....

My AP said it is MY job. She said that I have building senority and will be able to bump whoever replaces me even if they have more yrs in system.

I am going to try to get a FIRM answer from UFT and will let you know asap. It seems everyone says something different! ugh Chat Icon

I went out on childcare leave in the city with 7 yrs on and have been out for 7 more yrs. Many other teachers have surpassed me in seniority. In fact now all the teachers under me have been excessed and their is a good chance I will be excessed when I return. When the atr passes you in seniority, I believe your job will no longer be secure in your building, just as it is for a teacher.

Hm. Would it be weird of me to email my replacement and ask what year she was hired? I really don't know how much less time she has than me. I have more building seniority than her; would that make a difference?
