Well the husband is obviously reaching because he knows he is going to get his azz handed to him in court when the civil case gets served. He will lose everything.
What I don't understand is why is it the husband's fault? She left at 9:30am and crashed at 1:30pm. The owner of the campsite said she was "as sober as a judge" when she left. I seriously doubt if she were hammered then that her husband & her brother would let her drive with those kids in the car, so why does this fall on him? I understand financially b/c they were married, but are criminal charges being filed for him?
He is responsible for the death of his child if he knew she was drunk or knew she intended to get drunk, so that is what is under investigation. It would be hard to prove that he knew I would think, and there is a very good chance he did not know. But if he did know, he is guilty of negligence since he put his child in a dangerous situation willingly. I can see why the county needs to do this, both for the children who died, and also for the child who is still alive to ascertain that he is an appropriate caregiver. It's too bad, but I can understand it.
He also may be sued by the family of the people she killed, but that is a civil suit and a different matter. This is probably why the family is saying they think she had a stroke now, I'm sure they don't want to lose what they still have. I feel bad for him, but then I can also understand why the other family would sue--they lost their loved ones also and for no good reason.
What bother's me about this situation is that if Diane was to have lived a case against her husband would never happen.
They would have their guilty party and he would not be a risk of losing his only living child.
Side Note: I saw an interview with an addiction counselor and she said it is very possible to be a closet alcoholic. Closet alcoholics prefer vodka because it doesn't smell and they usually drink around their schedules, so it goes unnoticed. She said someone like Diane may have felt that her drive home was her 'free time' to drink after her vacation with her DH and jumped on the chance.
The video at Mcdonalds showed her to be 'normal' so I think Daniel and his nutso attorney could very easily prove that he did not know she was a drinker (which could be the truth) but he could be held liable if he gave her the pot.
