there are more expensive cars then ours in the garage- including a lamboughi-

so it's our fault???? they stole my car and it's my fault- that makes sense

edited to add- we were parking it on the street in Long Beach- so to me this was a step up

In my "expert" opinion (which I gained while watching many late night episodes of Law and Order Chat Icon )...It's possible that the tapes from this past weekend haven't disappeared, but have actually been taped over. Some places only keep the tapes for a couple of days and then tape over them. I DON'T KNOW IF THAT'S THE CASE HERE, I certainly hope not.

But hey, I could be very wrong, since I usually watch more SVU shows than regular Law & Order episodes.

So sorry this happened to you. It's outrageous. I hope it all works out for you and that you can get out of your lease... don't blame you for not wanting to live there.

Seems like you are doing all the right things. Did she refuse to give the tapes to the cops??

It may be true she is not turning them over at the direction of her superiors. But - she certainly doesn't seem like a nice person. I can't believe that she slammed the door on a resident whose car was keyed in that garage. Doesn't seem like they hire the caliber employee that should be working in a high end bldg....

she has them- they are ditigal and she has to turn them over- otherwise I think she would be more liable??? my legal knowledge also comes from law and order


if she did anything to them- I think she would be liable since there is an issue

my real estate just called the guy I rented my apartment from and he siad SUE THEM and the CO-OP

and he wishes he could help- but he has nothing to do with the gagarge

I am so sorry you are going throught this - my DH is a car nut and he would be absolutely livid.

Just a few things I wanted to mention:

In the event that they do destroy the tapes and you decide to pursue this I would look into whether there are any corporate policies on their part as to tape retention meaning they are required to retain them for X days and in this case they have "suddenly" been taped over.

An argument could be made that the garage is a subcontractor of the building and as such they may not be absolved of all liability.

I would carefully read my lease agreement as well as the valet parking ticket.

I also think that if it can be proven that the car was taken off the premises it is indeed a criminal case as they are surpassing the authority that was given to them. If you contact your insurance company they will in all likelihood fight this claim for you.

I probably would not go the route of trying to get the warranty to cover it b/c I can assure that they will not. I work as a lawyer for the "other" car company and can tell you if it was not a defect in the product itself they will not cover and if the car is not stock it won't be covered. SOmeone would have to take out all modifications and make it look stock.

I don't get a ticket when I park there- I leased a space

since I am new I have a floating spot- so they can move the car round the garage

I checked my contract- they have no right to take it out of the gagrage for any reason

Just because they don't want you to stay doesn't mean they are going to give you all of your probably 'non-refundable deposits' back that you are asking for. Considering they way they're acting, they'll probably just make your life harder so that you get frustrated and leave.

Just thought of something - the building I used to live at in the city had a parking garage that was contracted out to a parking company so obviously the parking co had cameras. However, my building also had a camera right outside the garage door that the doormen would view. Maybe your building has something like this as well? It may be a long shot but it may be worth looking into.

I asked- I thought of this yesterday- the car would of had to gone in front of the building to get out

I am sorry to hear about your DH's car. You need to take a step back and be thankful that both you and your DH are safe, healthy and all the good stuff. A car, a home...and all the material things should not be above health, happiness and personal safety. JMO

yes the car is material- but I am not happy- I don't feel safe in my own home- this wasn't some random gargage- this was the people working in my building

it takes to a whole new level of violation

Jake could have been hurt or killed when his transmission blew-

how would you feel if you didn't even feel safe in your house?

I agree. it's a major violation, you should feel safe in your own home, and anything could have gone wrong with the car, or been done to it, and that is a major safety issue.
