I have an illegal apartment and I don't see anything wrong with it. Maybe part of it is that it's a friend and he's been here for almost 3 years. He doesn't pay utilities, but his rent/contribution covers our home taxes. And in fairness, they could never get me on the "illegal" part because we are friends/roomates if anyone asked. There is a door at the bottom on the stairs and it's never locked, so we're free to walk into each other's places whenever. I'd be furious if someone tried to report me. But that's just my honest opinion on the matter.
ITA-I have never had an illegal apartment but my Goodness everyone is SO CONCERNED with what others are doing. Why??????
When it affects a homeowner's property value and neighborhood, it's a legitimate concern ...........

ITA. I think it makes people feel big to rat others out. They were probably the "tattletales" when they were kids.

Re: Illegal Apartment
I have a question. Can ANY illegal apartment be made legal?
I know in Queens that some houses just cannot have legal apartments because of how they are zoned so is it the same in Long Island?

It's simple and i'll tell you why. PROPERTY TAXES.
The towns are not collecting their share of taxes on these illegal apartments.
And people wonder why Long Island taxes are always so high. Maybe if the local government had a more effective way of taxing these people with illegal apartments I wouldn't be getting the bottle out every time my tax bill shows up.

Well like I said, in my situation the lines are a little blurry. I am zoned as a MIL apt. downstairs, so that is not to say I can't have someone living down there. I don't feel like I'm breaking the law, sorry if you do.

It is very possible. Usually it just takes a few adjustments.
The basement apartment I lived in was made legal after someone turned them in and the only thing they had to do was add a parking space for me.

Re: Illegal Apartment
IMO if the illegal renters arent impeeding on your life in any way, why report them? DH & i lived in an illegal apt for a year and half before we got married & i do not know what i would have done if someone reported us & we got kicked out
do you know how many other illegal apartments there are in your town?!? probably A LOT
unless there was sketchy situations going on or they were causing real problems on the block, i would never call to report an illegal apartment. sadly, as everyone said, its one of the only affortable places to live on LI for some people

I wouldn't go out of my way to report them, especially if I was on good terms with my neighbors. It's not like I am looking for every legal apartment out there and I can sympathize with the tenants (to a point).
But like Porruss said, if this becomes a nuisance then yes I would most definitely make a call.
And if they ever find out it was me that reported them, that's fine too. I'll tell them in their face the same thing I say here. Pay your property taxes.

It is not legal for rent, as the upstairs and downstairs are connected. I'm zoned as a 1 family, with a MIL set up downstairs. But like I said, there is gray area. Because it's a friend, I can legally refer to him as a roomate, which he kind of is. We walk in and out of each other's places with a simple knock, he'll watch DS for me to run to the store, we'll take care of each other's pets, etc... The bottom line is that I don't consider his payment as rent or income, it's a contribution to our household expenses. The only thing illegal about the setup is that he has a stove. And sorry, I don't feel like I should feel guilty over that.

that's interesting b/c I can understand where ave is coming from because of her property taxes being so high.
did you JUST buy a home.. (maybe your tune will change when you get your taxes j/k)

i know what we pay in taxes & yes, of course i would like it to be cheaper... but by reporting illegal apartments or not, there are always going to be things that i cannot control that go into owning a home that really pisss me off
i just dont think that reporting illegal apartments are going to make that big of a difference... b/c if its not taxes, its something else with a house... plus like i said, i lived i one with DH - there were horrible circumstances why we could only afford to live there & it would have pretty much ruined our lives at that time to be kicked out...so i know how those ppl feel & like i said before, uness there were scketchy things going on, i wouldnt report them
ETS: the illegal apartment i lived in was reported a few years before we moved in... that obviously didnt do ANYTHING b/c we lived there for a year and a half and there are different tenants living there now

you don't have to explain your 'situation' to me...
I think in the OP's case, I can understand why she would report them. Personally, unless the tenants changed constantly, I would probably let them be as well...

Where is anyone saying you should "feel guilty". Feel however you want- but the truth is, what you are doing is considered illegal and it would be well within someone's rights to report it.
I concede that there is a reason and a NEED for illegal apartments. However, no matter HOW anyone rationalizes it, it is still against the law......

not to be rude but....for those of you who do not agree to illegal apts, i'm sure you would "change your tune" if you were the one who lived in the apt.

Re: Illegal Apartment
I can understand both sides of the argument. As a homeowner, I think everyone should pay their fair share of taxes. But on the other hand, I can see the appeal of an illegal apt. for both the renter and the HO.
