For those that think it lowers property value, is it better to have a house on your block foreclose bc the owners can't make mortgage payments without the help of a renter?
ETA: I just reread this question and it sounds snarky, I am honestly asking it because I don't know the answer, lol.

In my opinion there is nothing wrong with this...My friend is a stay at home mom and uses the rent so that she can be home with her child. You may be ruining someone else's life by being petty and selfish. ( My Opinion) There is always a nice way to fix things, maybe have a talk with whomever. I think calling the town should be a last resort.

Calling the town should be the FIRST resort. This is a legal issue above and beyond the scope of what neighbors could kindly "nicely" discuss among each other. I don't see why anyone would recommend "talking" to the neighbor. As if the neighbor will care what you think. He apparently doesn't care about doing the "RIGHT" thing or he wouldn't be doing the illegal renting (even worse, to various people) in the first place.
Being direct with the neighbor will only alert them that YOU are the one who reported him/her when the town comes knocking (since it will HAVE to come to that b/c even if you did try talking to the neighbor, they would care less about what YOU want, obviously they don't care about the law even) and doing this would only cause larger tensions, there is no doubt about that.
Call the town and don't think twice about it. Various people coming and going is a huge issue that needs to be addressed.

I would go for the foreclosure, esp over the situation the OP described about various renters coming and going. Eventually someone who COULD afford the home would buy it.

I think it's pretty selfish to put your self and your desire to stay home with your children above what is right for your community and neighbors who are playing by the rules.
Times are tough and taxes stink, but that doesn't mean it's a valid reason.

i know what we pay in taxes & yes, of course i would like it to be cheaper... but by reporting illegal apartments or not, there are always going to be things that i cannot control that go into owning a home that really pisss me off

I agree, I live in Queens, NY and there are plenty of illegal apts. They get reported and within a few weeks they are renting again. So it seems getting caught only causes a minor hiccup.
One other negative aspect of illegal dwellings I haven't seen anyone mention was the fire hazards. I have heard that it is difficult for firefighters to properly clear a house or fight the fires because there are walls or blocked entrances where there shouldn't be. Maybe more of a problem in Queens, where the basement is normally the illegal APT.

What about this scenario which I often see in Queens.
Someone buys a 2 family house with basement.
They rent the 2 legal apartments and they themselves stay in the basement. Would this now be considered an illegal apt, since no income is taken in, and its the homeowner living there?

If there is a stove and bathroom/kitchen in the basement it's probably illegal regardless of who's living or renting there.
So I would guess to say yes. But at least that family is paying taxes on two apartments.

That was sort of what was going on in the building I lived in. It didn't occur to me at the time, but I'm not sure if it was all legal. The house was owned by a man & his 2 adult sons. The owner & his wife & 1 son lived in the basement.
The other son & his wife & baby loved in the small 1st floor apt & then the 2nd & 3rd floors were each rented out.
The set up seemed legit--the 2nd & 3rd floors were big & defitnely designed to be seperate livign areas. It was rented through a realtor, there were seperate meters, but the basement apt was proabaly illegal, and we didn't have a lease, and payed cash, so taxes may not have been reported correctly.

I have nothing against illegal apartments...I would rent one out if I had one and would rent one if I needed one.
With that said I am dying to call the town on my neighbors. There was a husband wife and child...the wife and child left for some reason. The husband now rents out the illegal apartment in the garage and all of the bedrooms to a bunch of young dirtbags. We and other neighbors have had to call the cops numerous times. Cars constantly pulling up and leaving...about 15 kids hanging out in the driveway smoking pot...fighting like you wouldn't believe...dogs running into our yard...including a doberman. There was actually a time I literally had to toss my sons infant carrier into the car because it came running at me. Last week we called the cops because there was a brawl with about 30 kids...metal pipes and all. We live on what was a quiet dead end block with alot of small children...there is no need for this to be going on.
I feel we have every right to call and won't feel an ounce of guilt

you know what annoys me about illegal apartments.....when their tenants constantly park in front of my house and block my vision up the hill & almost cause me to get into accidents while pulling out of my driveway.....& sometimes it's two cars!!!
Good thing I like my neighbors! (they've had 3 tenants in one year...annoying)
I see both sides of this story!

The ONLY reason we were able to stay on LI as long as we did was because of the illegal apartment we were renting. We were there for 2 years. Yes, we parked on the street.
It was the ONLY place we could afford as a newlywed couple, and I thank God every day that people were a little nicer and never reported us. They definitely could have. But they didn't.
That said--now that I'm a homeowner, if I knew my neighbor had an illegal apartment, I would NOT report them unless, as one of the other posters said, it was clear that some sort of dangerous activity were taking place there.

I hear M/D tossed around on MLS but never bothered to figure out what it was. I just figured it was some sort of legal apartment.
It means just that. Its a legal apt for a family to live together. Like a mother main floor daughter in apartment.
Or son in apt. My MIL lives in Levittown and she was going to make a M/D out of her house since we could not afford LI house prices but we moved to FL 3 years ago instead. She was told that they were cracking down on illegal apts in the Town of Hempstead so she was told if she was going through with it to make sure she had all paperwork if she was going to do it or she would be fined per day.

For everyone who is so against them...you are blessed. May you and your loved ones never have to fall so low that you have to call one home. But I'm sure many of these apartments have helped many people get back on their feet again.

I have NO problem with illegal renters BUT, I had to report my neighbor.
This is why...
They parked their rusty disgusting van in front of my house EVERY DAY for 2 years and it leaked oil everywhere (it wasn't even registered). I would have to fight to park in front of my house and if we backed up so they couldn't park there, they would park in front of me. THEY HAVE A DOUBLE CAR DRIVEWAY!!!
They had disgusting crap in their backyard and every time I had a bbq, the guy would work on his snow blower or dirt bike and blow all of the smoke in my backyard. It was the summer, do you really think he needed to do that in June?
I'm sorry, I rented too and I tried to be as invisible as possible. If you don't respect me (the one who is paying all of the taxes) then you will be reported!!!
