new fence and neighbor?
our neighbor came by today to talk about getting a new fence. I wasn't home so she spoke to our nanny.
the back of her property backs up to the side of our property. so the shared fence is only along one side of our front yard.
she said the fence that is there now is ours. we just moved in so I had no clue if it was our fence or not. it is old and definitely could use an upgrade but its not falling down or anything.
problem is we really don't want to spend the money right now. so how should I handle this? what is my obligation?

I don't understand this lets share the cost of a fence thing.
When we moved in we wanted a new fence so we put one in. If we couldn't afford it then we would have waited. You are under no obligation to pay for any of the fence they want. I would have no problem telling them that they are welcome to go on your property to put the fence up/remove old one if needed but right now a fence is not in your budget.

I agree. we've discussed replacing the fence in our backyard down the road and it never crossed our minds to ask the neighbor to share the cost with us.
I'm annoyed by this but I want to be the friendly neighbor as well. its really not in our budget. we have a long list of other things we'd rather spend our money on.

You are under no obligation and the sharing of the fence is extremely stupid IMO. Should be one person who owns and cares for it, is responsible for it to avoid any confusion down the line. Say no, if they want a fence they are more than welcome to put whatever they want up. Now maybe they are just asking if you want the old fence removed if it's in bad shape…maybe they aren't looking for you to chip in anyway?

those are good points. I have to talk to her and see exactly what she's looking to do. if she's putting up a new fence and wants to remove the old existing one that is fine with me.

The fence will only sit on one person's property. So whoever's property it sits on is who should pay. You may benefit from a neighbor's fence, but that doesn't mean you should pay for it.
When our fence was installed, we had to give our installers the map of our property so they could measure it and ensure it was sitting entirely within our property - not on a neighbor's, not on the border. Fully on our property.
I don't understand the idea of sharing the cost.

I don't understand the sharing the cost either, it makes no sense. The fence will only belong to the person who's property it is installed on. If the fence is in fact theirs, and they want a new one, they need to pay for it.

so I'm just going to be as polite as possible and say that a new fence is not in our budget right now.
they can then choose to do whatever they want.

And then say you ever sell down the road, does that need to be in your contract that the neighbor is half owner of the fencing?! Or say there's damage one day from a storm, a tree, a kid..etc. who pays for it to be fixed? Is it split again or will you decide which panel belongs to which person lol.
I would think the best way to keep future peace between neighbors is by NOT sharing anything.

If you just moved in, then ask your attorney for the property survey and map. It will tell you exactly where your property begins and ends. Or check your closing paperwork. It may already be in there.

We also paid for a new fence ourselves and did not ask the neighbors to chip in. We gave one of the neighbors a heads up that there would be a new fence going in. But i'm sure he was glad we were installing it because our old fence was falling apart.

We moved in and put up a new fence. Never Asked any neighbors. Noticed that the people bordering us quickly put their own up after using one side of my fence as theirs. Whatever.

Ah. Ridiculous and stupidity IMO. We aren't kids splitting a bar of candy. We are homeowners who if we want our own fence pay for it. Duh.

My neighbor did this at my old house- we told him a fence was not in our budget. We installed a new fence in the house we are in now. We told all of our neighbors that a fence was going in since 2 of them have dogs and we wanted to make sure they didn't get out (which is how the only dog I ever had ran away). I would never ask a neighbor to split the cost.

We are installing a fence right now on our property. I do not know whose fence the old one is. I told my neighbor I was installing a new fence just to be polite but I didn't ask their permission or to pay for anything. But I will say that I know alot of people that shared fencing with neighbors, it is not really that strange of a request. You are in no obligation to pay for anything but I do think its nice that they told you and asked.

I agree with prev poster that its not unheard of for neighbors to split the cost of a fence. You sre under no obligation to pay for the fence if they decide to put a new one up.

We just moved into our home in January and had a fence put up last week. I let my neighbor know as a courtesy and she actually mentioned that her other neighbor got a new fence and they split the cost. I was surprised she told me that but I still did not ask her to split with us. It was our decision to get a new fence, and the thought of splitting never came into my mind. I would never expect that from her.
You can be the friendly neighbor...but it's not her problem if you don't want to replace it right away. That's your decision and she will have to respect that.

yes that is how I feel.
to add, when we got home from work last night we were looking at the fence and its actually in pretty good shape and looks nice. its wood so it has that "aged" look but its not falling apart or anything. there is no way I'd consider replacing it any time soon.
so my neighbor can do as she pleases
