I thought thta while on disabilty for 12 weeks they had to hold "your" position, after that your are still on disabilty but when you came back (at anytime) that had to give you an equal position? I guess I was wrong you should look in to that though...

I havn't done HR in a couple of years but I do work for a very large company and in NY so it might be a little bit of company policy and a little bit of law but.... When some one is sick they more than a week or two we put them out on disability (first short term then long depending on the sititution). They can be out on disability for 1 year after that one year they get a letter to the house stating that their job will be termed if they are unble to return. Normally when someone has a baby they take 6 wks disability (natural) 8 weeks c-section. After that period of time they can go out on FMLA for 12 wks.
Disability should be carrying you and I don't "think" the company can Term you.
Our company would do the same thing and term the person after the 12 wks and their reasoning for that is even though that person is not work the company is carrying their benifits, pays SS taxes, accru vac, sick time, bonus's etc to keep this person on their books.
I think they should have changed your status from a Materinity leave to an L3 Disability (long term). Try to talk to someone in the HR dept b/c I am not sure the current laws regarding leave but something dosn't sound right.
Good luck ETA there is no such thing as holding your job.. The company has to take to back to work after a leave with the same pay and work classification they DO NOT have to put you in the same position. For example if you where a supervisor they must take you back as a sup but you could be overseeing a different dept.

Deb that is a horrible thing for them to do to you. I hope you write a letter to your local paper and send the same one to your CEO. They should feel ashamed and I hope what goes around comes around for them!!!! Lots of for you!

Does this affect your medical benefits in any way?
What type of short-term and long-term disability benefits did your company offer? Did you receive any disability benefit payments from them?
I think that you have to be able to work in order to collect unemployment. On the other hand, you have to be NOT able to work (considered totally disabled) in order to collect Social Security disability.
Start applying for Social Security disability NOW. It may take a while for coverage to be approved. Benefits would begin six months after the date they say your disability began.
Calls to your local politians (especially those up for re-election) wouldn't hurt, either.
And, make sure your DH understands exactly how his absences may affect his job, too.

Deb I am so sorry. As if you haven't be dealt a bad enough hand already they just made it even worse. I am sooooo sorry. What goes around comes around and I hope they get theirs. I can't believe how insensitive they can be at such a difficult time for you. They should be pulling together to help you at this difficult time, not pushing you away like this... I wish we could get their info and write some serious letters of extreme dissapointment.
Hmmm, the idea about writing letters, makes me think of... what channel does the SHAME ON YOU report ??? ShAME SHAME SHAAAAAMEEE SHAME ON YOU !

Oh no...I am so so sorry to hear that. Legally, yes they are in the clear, but MORALLY - no, they are wrong and heartless. I am really sorry You should be able to collect UI since you were terminated and did not resign and you were not termed for insubordination or anything.
