All for it. Not meaning to insult anyone, but I feel as though they should be banned while driving a motor vehicle period. Just like having a hand occupied due to a cell phone, cigarettes do the same, but what's worse? A driver dropping a cell phone on their lap or a lit cigarette?
Not for nothing, I don't feel as though anyone should have to be suscepted to second hand smoke that can possibly kill you. Again, not trying to be mean or cause an insult to anyone, but honestly we all know how unhealthy smoking is. I don't know why some choose to do it in the first place knowing this. However, those who make the decision not to smoke, especially children, should not be exposed to this...its unhealthy and can kill. I think preserving the life of others should be the first priority of others.

ETA: A few stories...my grandmother was once driving as a passanger in a car w/ the window open and someone flung a lit cigarette out of the window of another car and it landed on my grandmother's lap. Also I personally feel that there is nothing worse then driving my car w/ an upper respiratory infection and having smoke from a discarded cigarette blown in my face via the vent.

I'm a smoker trying to quit but I'm all for the ban. People shouldn't smoke around children PERIOD. They are not old enough to make their own decisions about their health and it's one thing if you want to smoke but it's another to subject your children's lungs to it. Trust me...you can wait until you are out of the car and away from your kids. I don't even like to smoke around my pets!

No offense, but I think it should be BANNED COMPLTELY. Period.
Watch anyone you love hooked up to a respirator, sedated, while their lungs get suctioned just to clean them out. Watch them suffer with lung disease, emphysema, chronic illness, nagging cough, and heart problems.
I can't see how they can still sell these things.

I hope you can gets some pain relief soon, Deb--keep pressing that button!!
I was referring to my dad--but during the worst part, while he was intubated, he was sedated--so he had no idea what was going on.
I am VERY happy to report that he quit smoking after that--we thought he'd never come off the machine--and to have him not only come off the machine, but also quit smoking, we are all shocked and SO happy about it!
I hope you feel better soon!!!

As a former smoker (of 15 years) who quit just a few months ago, I am ALL FOR THIS!!! Anything that gets more people to quit is a good thing. My DH is still smoking and so addicted ,I am trying desperately to get him to stop but honestly wuold never let him light up in the car with me or anyone else for that matter. I think I read recently that second hand smoke in a car is almost as bad as smoking yourself. After the hard time I had quitting and the 25 pounds gained and the anxiety and withdrawl, it's not worth it for me!! I really hope they enforce it soon!

thats awesome. I am soo glad that it was enough to get him to quit. I never understand people who go thru that and then they get out and light right back up first thing.

I'm absolutely for it but have concerns on the erosion of privacy. I don't consider a car a private place (no matter what anyone did in highschool ). I wonder if it would apply to a home as well.
I am 1000% against smoking around children. Having a son with respiratory issues, RSV, etc, I cannot stand when people smoke around him or my daughter - to the point where I've almost gotten divorced over my ILs smoking.
My concern with the privacy issue is what else would be deemed for the health of a child and if the laws would apply for those as well.

I would be more in favor of the law if smoking was banned because it's a distraction like cell phone use. I think writing the law like this does leave it open to ban smoking in your home in the future.
I don't know how they would even begin to enforce the law since the cell phone ban does not appear to be a deterrant and smoking is easier to conceal then having a phone at your ear.
And I also see some bratty 17 year old ratting out their parents for smoking in the car with them in it to get back at them for xyz.

Am I the only one who thinks this is a little Totaltarianistic? I am all for ecouraging people to have a healthy lifestyle, especially with & around children, but I think this is just another way of slowly robbing us of our freedoms. Smoking is not illegal, and to place a ban on a legal iutem seems like a bad precedent.
Before anyone flames I am a former smoker, and I have lost numerous people to lung cancer & other smoking related illnesses & watched them suffer, including my grandfather who meant more to me than almost anyone else in this world. I just feel like we are humans, adults & can make our own choices without the government dictating them. JMO

Where are the childrens' rights? The right to a healthy life?
I think the loss of that "freedom" is well worth it.
Drinking is legal, but yet it's against the law to drive while under the influence...why's that? Could it be that it endangers the well being of others (and yourself)? Same with cell phone use. And smoking in a vehicle with children present falls into that category.

If you don't like this ban, then don't move to CA. In many places - you cannot even smoke outdoors. Even some apartment complexes ban you from smoking on your own terrace because it bothers the people around you.
I say bring it to NY! I love the smoking bans!
