Tax grievance question
Dh and I purchased our home in January the previous owner filed a tax grievance the previous year. Who is responsible for the fee? Tia ladies! I can't afford this right now and it's so disheartening to see such a large bill right before the holidays. He put the bill in our mailbox if it means anything.

you shouldn't have to pay since you are not reaping the benefits and did not ask for the service. filing a grievance is free if you do it yourself online...it was the previous homeowners choice to pay for that service. you should def not be held accountable for it.

That's what I thought! I really can't believe the nerve of this guy! Does he get money back? Thank you for answering..... I'm already so stressed and stretched money wise I can't deal with anymore lol

I wouldn't stress about it. as long as you can prove you did not own the home at the time the grievance was filed nor that you received any payments from it you should be fine. your azz is covered.
I'm not sure how the payment works out as I am currently in the process of dealing with my own. Just got the paperwork back last week after filing months ago.

He put it in my mailbox! Didn't call or even leave a little note, he just stuck a bill addressed to him at his address in my mailbox. Thanks, I feel a little better about it...... It's always something lol

Honestly it all depends on when you purchased the home and the period the tax grievance covers. Because of the way tax years run, you ARE probably receiving the benefit. However, you did not authorize the grievance. You can contact whatever grievance company they used and inform them tgat you are the new owner and you did not authorize the grievance. They then have the right to contact the assessing jurisdiction and hsve the assessment put back to the previous level. Whether they will do this or not is a mystery.
if there is a refund due for any over payment of taxes, it must be apportioned between you and the former owner as of your closing date. If it is not, yiucan take them to small claims court.
Either way the first thing i would do is call the grievance company.

thats what i thought too but then i looked online and saw people saying they were receiving checks? i was unsure too as i'm in the middle of it now so i have to just agree to my grievance terms.

I definitely wouldn't pay it! The previous homeowner signed the contract with the tax grievance company, not you. It's his problem IMO, unless of course you signed a contract to take over the bill.

Whether you receive a refund or a credit on your tax bill depends on where you live, when the case was resolved, how backlogged the courts, assessor and tax receiver are.
even though you didnt retain the company to do the grievance, it may be covered in your contract of sale.

When I grieved my taxes I did it myself and won. I didn't get anything back, but our taxes went down.

Well we purchased the home January 23, 2013 and he applied January 26, 2012 for 2013/2014. I called the company when I got home from work and saw the opened mail (addressed to the former owner) in my mailbox but they were closed so I left a voicemail. So you think even though the bills are addressed to him and he doesn't pay they will make the taxes higher again? Now I am confused as to what to do :( if that's the case I guess I will have to bite the bullet and borrow money from my parents(which I hate doing) to pay it because it will be helpful to have a lower mortgage payment..... That's what I thought but he never even mentioned he grieved during the drawn out like 4 month process. He had plenty of time to bring it up and he wanted money for just about everything else so I don't understand why he wouldn't have mentioned it! I am thinking he forgot he did it until he got the bill. If they can go back and make the taxes higher again I feel like I have no other choice now

I know the county (Nassau) owes my dad money but I think it might be because he started grieving in 2011 and they never approved it and then eventually they did so now he is owed money if that makes sense? This entire thing is confusing lol.

To me, it sounds like they obtained a refund for the 13/14 tax year that he approved when he owned it. You DO NOT owe any money because you did not authorize the service. There is no way the assessor can change your assessment back to the way it was, since the tax/assessment rolls are finalized in early 2013, and it is illegal for them to change them now (except in certain circumstances, and this is not one of them). Don't pay it- I doubt the tax grievance company would even ask you to.

I would also contact your agent/ lawyer you used for buying thr house to get the legal info on this. I dont see how you could be held accountable for a service he attained. If he knew he was selling his house then he shouldnt have grieved them or he should have let you know and said he wants $ for it. If it wasnt in the contract then i dont think you should be held responsible.
Def contact your lawyer.

Thats what I am hoping for. If I had signed the contract I would have known to save to pay the fee just in case it was approved. I want to call him up and tell him off but DH said no lol plus that wouldnt end well

I just got something in the mail from a company that ones this. I don't think you would have to pay them, they get half of what the difference in taxes would be. Since you didn't file, you shouldn't be responsible.

I don't think you need to contact your lawyer. Just don't pay the bill. You will get the savings, and there is no way the grievance company (who was it by the way?) can come after you for the money b/c you did not sign up for the service. The previous owner will owe the fee, and you get the benefit. These companies waive fees like this all the time. I doubt they would even ask you for it.

The bill is not addressed to you. I would mail it right back to him.
And I would definitely still speak to the attorney you used when you closed. They probably have experience with this type of thing.

You are benefitting from the reduction in the form of a reduced tax bill. Contact the company, they will most likely tell you not to worry about it. And while they cannot tell the assessor to increase the assessment for the current year, they can advise the assessor of the sale and the assessor can absolutely increase the assessment for the followibg year. Will they do it? In a ll likelihood - no. However, I have seen it done a VERY small handful of times. The Nassau county assessment dept won't bother with it - they have too many other thibgs to worry about!
I wouldnt bother contacting your lawyet UNLESS the comapny is insisting you pay the bill.

You ladies have been so helpful and I am going to come here for opinions more often So I did contact the attorney I used for closing (she is amazing) and basically she said the same thing as all of your. It even says he is responsible for the fee if he sells or moves out of the property. So F that guy lol I am mailing him back his papers (after making myself a copy) today

haha I put them back in the open envelopes he left them in but I am leaving a post it saying "I think you need these" Just people stressing me out for no reason =} F him and happy friday!!!!!
