WWYD? Family member, fraud and Bankruptcy?
My DH and I HAD to file bankruptcy out of pure desperation/last resort. Not proud of it, nor did we take advantage of the system. We did what we had to do to just make it.
Family member, with a VERY high credit score and small debt, in a 2 month span purposely charged thousands and thousands of dollars (probably $70-$80K), took out new credit cards, remodeled house, new appliances, furniture, sterio equipment, paid off car, etc. the works, because he decided to do bankruptcy just to get away with doing/buying all of this and not having to pay his bills. No need to do it, just said, hey, I can get away with it!
How does someone morally do something like this? How can you live with yourself? Bankruptcy is not there for your pleasure and amusement.
Part of me is jealous just because we had no choice but to do it and we have absolutely nothing to show for it. He has new EVERYTHING. He even bought a house included in this plan. We have cr@p basically.
Anyway, I strongly feel that he should NOT be able to get away with it. It's just not right? And to top it off he's using the attorney we used to do it. The thing is, is that this person is older than me, but has to do everything that I do or get the same exact thing that I buy. No joke, it's sad!
Should I tell someone or just let it be? Will the attorney get into trouble for this if his client gets caught? It's just so hard to just let it be you know? It's not right and they don't care. WWYD?

How close in time were the expenditures to the date of the filing? That's what will determine whether there will be any accusation of fraud. There is also some potential liability on the attorney's part, under BAPCPA, the Bankruptcy Abuse Prevention and Consumer Protection Act. In my opinion, there is a little bit less of an issue if they file a Chapter 13 than a Chapter 7 but that is just my opinion.
