Most people work without a contract. It's called at-will employement.
They still get paid
They still get pensions
They still get health insurance.
At Will employees get paid on very different scaled and have different regulations for raises than a union employee does - we don;t need a contract that states what our raise will be ...
They don't get pensions, most people in the pricate sector get 401k's ... money they themselves contribute ... do you know of any public company that still gives out pensions (to someone our age not grandfathered of course?)
We pay for health insurance, they never did.
NOT TRUE I work for the STATE. I am a STATE employee with a union..
We got many many months without a contract nothing changes...

someone needs to remind them what "retropay" is!
I don't think retro pay is any great incentive to work without a contract- I just got a retro check and *half* was taken out in taxes. I don't know how it will work out at tax time, if I'll get some of it back, but I wish I'd had it all along.
Its all relative. You don't get taxed any more on retro pay than you do on normal pay.
If they take out more tax... its just for your own benefit. If you remain in the same tax bracket... that money will come back to you at tax time.

I hope that didn't come across snotty! I just was trying to explain it.
Are you an NYC teacher?
Nah- I didn't think it was snotty.
I do teach in NYC so this contract/union stuff is all too familiar.

By them striking, they're not endangering the lives of others as a health care worker strike would or a police department or fire department strike would. It's annoying, it s*cks -
I think in a way it does endanger every person that commutes in NYC..... For instance..take a member from LIF.....who is pregnant and walked many blocks to get to her job.........Please go back and see how she and her baby felt after walking all those blocks...... To all of these people that are after a certain age and need to take the means of transportation available at the moment but yet that have to walk a certain distance....consider their age....consider the weather outside....consider if they have ailments....like asthma for example.....let alone the craziness and the chaos that is happening at those stations that are overcrowded with people...... In my view, it's more than inconvenience....... I was fortunate enough to drive from Suffolk to Queens and drive in with 3 other friends...but not everyone has that option......

wouldn't the $$ taken out in taxes come out the same if it were broken up between checks?
To be very honest, I am not mathematical and don't get how it works- but the man I share an office with told me he took home $2800 from a $6300 retro check.

I understand what you're saying, but it's not the same. There is not a DIRECT endangerment of lives here - these are indirect affects. The 'inconvenience' is maybe staying home from work then. But if there is a strike of firemen, etc, there is a very direct, very dangerous affect. That's the point I was trying to make.

I agree. The retro check gets added to the year's pay for when the contract was settled. So instead of paying tax on it all along, you get hit all at once, at the higher salary you got for that year.

meanwhile we are the lucky ones we can stay home or be late and not get fired or punished but what about people less better off then us? What about the people who NEED to show up or else get fired, or one day not worked means they can't cover their rent? I feel bad for THEM, not the transit workers.

Its not like a retro tax is taxed in a higher bracket.
Here is a solution for those of you that don't like this. Tell your employer to NOT WITHOLD any taxes on your retro check. Then you will get a really FAT check.

Re: Post Your Feelings About the Strike.....
Pataki is giving a news conference right now.
He said that the TWU walked away from the table. Also , that the MTA has made a fair offer and is still at the table wanting to negotiate. The MTA has asked for mediation or arbitration and the TWU has refused.

I don't think anyone was saying they were stressed about it, just that the promise of retro pay was not a huge factor in deciding to strike or not strike. At least that was my feeling.
I got a retro check this year and that will be included in this year's W-2, so depending on how large my raise was, it could bump me into another tax bracket.

But they walked away and their strike is ILLEGAL. There is a reason the Taylor Law is on the books.

I'm not stressed about it. I was just saying that the idea of working without a contract with the idea of seeing retro money, for me, was not an advantage of working without a contract.
And while not having taxes taken out of a retro check is a lovely idea, I don't think it would have been an option.

Re: Post Your Feelings About the Strike.....
I feel bad for the workers, but I think this strike is SO wrong. The MTA employees get FAR BETTER benefits than I do, and I don't get a pension. I have a 401-k that comes out of MY salary, as does my health insurance benefits. These workers made a choice when they chose to work for the MTA. Everyone's job has things about it that sux but you sukl it up and deal. It's called "work", not play.

Indirect effects? No matter how you call it...direct or indirect....these are still endangerments..... And for some employees out there...especially some blue collars...if they don't make it to work...they don't get paid.....some companies I was reading online advise their employees that they could not take personal or sick time in lieu of not coming in if had not been approved in advance.... I understand your point that if Firemen and Police Officers were to go in strike, there would be chaos in a sense (except for the thiefs and those who not abide by the law...those would be very happy) but they all fall in the same category...Public Service......

It is an option...you can have your check for that week when you getting the retroactive not taxed the same way.....just change your exemptions......they have a word for it but it escapes me at this moment.....

Right, but I still have to pay that tax at the end of a single year, rather than paying each year's tax over the 3 years, unless I am supposed to go back over the past 3 years tax returns and make adjustments??? I don't know.
I will say that this morning, I wasn't sure what I felt about the strike, because I hadn't heard enough of the details. Now, I think they could have negotiated longer before going out. I hope it was worth the stiff fines to the union - it seems like they were close enough to agreeing that they could have worked it out.

I am not sure what you are talking about... but trust me when I say that you do not get taxed any more on retro pay than you do on regular pay. The SAME goes for overtime pay. You may see your job take out more for OT pay... but again its all relative in the end.
If the extra money you got from retro and OT does not put you into the next tax bracket... you do not pay any additional taxes!
And even if you go into the next tax bracket by say $100 buks... only that $100 buks is taxed at the higher rate... not your entire salary.
