North Dakota governor signs "heartbeat" abortion ban
By Dave Thompson BISMARCK, North Dakota | Tue Mar 26, 2013 2:22pm EDT (Reuters) - North Dakota on Tuesday adopted the most restrictive abortion law in the United States, as the governor signed a bill that bans the procedure in most cases once a fetal heartbeat can be detected, as early as six weeks.
Supporters of abortion rights said they would challenge the measure in court.
Governor Jack Dalrymple on Tuesday also signed a bill that bans abortions based solely on genetic abnormalities, the first state ban of its kind, or based on the gender of the fetus.
North Dakota is the latest state to pass measures to restrict abortions. Arkansas lawmakers earlier in March approved a ban on most abortions after 12 weeks of pregnancy that could take effect in August if it survives expected legal challenges.
Several states ban most abortions after 20 weeks of pregnancy.
Dalrymple, a Republican in a state with a Republican-controlled legislature, said the constitutionality of North Dakota's effective ban at six weeks into pregnancy was an open question. He said lawmakers should appropriate money to a litigation fund for the state attorney general to defend against any possible challenges to the law.
The "heartbeat" bill provides exceptions if an abortion would prevent the death or irreversible impairment of a pregnant woman, but provides no exception for rape. It sets up a direct challenge to the Supreme Court's decision in Roe v. Wade that legalized abortion in 1973.
"These are bills that have passed the legislature. This is what they want to do," Dalrymple told reporters in Dickinson, North Dakota. "They have a legislative right to find out if these laws can stand."
CHALLENGE PLANNED
The Center for Reproductive Rights said it plans to file a legal challenge to the six-week ban before it takes effect on August 1 on behalf of North Dakota's only clinic that provides abortions, the Red River Women's Clinic in Fargo.
"North Dakota has set a new standard for extreme hostility toward the rights and health of women, the U.S. Constitution, and 40 years of Supreme Court precedent," Nancy Northup, the center's president and chief executive, said in a statement.
"We will not allow this frontal assault on fundamental reproductive rights to go unchallenged," Northup said.
Roe v. Wade and later Supreme Court decisions have found that states cannot ban abortions before the fetus is viable.
Dalrymple on Tuesday also signed a third bill on abortions, requiring physicians who perform abortions in the state to have privileges at a nearby hospital that also permits abortions in its facility.

I'm getting really tired of these lawmakers just making decisions for what to do with MY BODY. So a rape victim would have to seek an abortion out of state if the HB is detected when they go to confirm they are pregnant? Unreal, I really feel sometimes that women's rights are moving more and more backward as time goes on.

I do not want any political figure telling me what is acceptable for my own body.
It's 2013 for crying out loud. I find it just as scary that we're still having the same argument for abortion as 30-40 years ago.
ETA: I bet this governor thinks womens bodies will just shut down a pregnancy, so there's no need for abortions

No, it can't, so cut the shit, North Dakota.
Why don't you focus on the high poverty levels that exist in your state and make sure that the children, the ones that actually are alive, whose parents are struggling so much, can live better?

These laws are being written to try and bring the case to the Supreme Court. I am concerned!
But I just love how we are forced to give birth no matter what the circumstances, but heaven forbid anyone talks about having health coverage for all.. which those pregnant women need.. or a decent federal maternity leave policy which those women will need when they are forced to give birth to these children that they may decide to keep.. and does anyone even care about these children once they are put up for adoption, and potentially NOT adopted and then have to grow up in the system, unloved and unwanted.
I guess morality begins at conception and ends at birth...

It truly is unbelievable. And god forbid the child is born and ends up being gay! Will they stand up for that gay person's rights? Absolutely not!

I would argue this will cause more abortions....if you only have until 6 weeks as soon as an unplanned positive comes up a woman might run to the clinic in fear of not getting an abortion in time.
Without thinking of other options (adoption, keeping the baby)

What if the mothers life is in jeopardy? Or the baby is diagnosed with a fatal abnormality? There are too many circumstances to put a bill out this restrictive, this is basically banning abortions. So much for roe v. Wade

Do you really think that a rape victim who is essentially forced to give birth to her rapist's child will take care of the unborn fetus while pregnant? Just because a woman can't get an abortion doesn't mean she won't try to do it herself, or try to miscarry, or maybe just not care about the welfare of the fetus? I highly doubt someone in that position will be taking prenatals, not drinking, not smoking, etc especially after such a truamatic and horrible experience.

We always talk about rape and incest as being the bottom line and while I agree the instances of abortions occurring in the case of rape and incest are less then 5% of the time. This is the minority not the majority, and it's not like every rape victim has an abortion either.
I am not against abortion, but i'm not for it either. My only issue here is that the petition was done on behalf of the clinic. It wasn't the clinic that filed. Let them fight their own battle or ask for help. This group did it for them. That's not right either.
