There was fault on both sides. This is an unfortunate accident. The cop should have gone slower, the boy should have stayed in the car. The fact remains, if the boy had stayed in the car, he most likely would have survived.

And it could have been anyone that hit him, if the cop wasn't there, it would have been someone else.
But it's easier to blame a cop. When in doubt- it's the cop's fault. Just a general rule of thumb.
Rather than saying- this was a tragic ACCIDENT that affected both the teen's family as well as the cop who accidently hit him and now has to live with it for the rest of his life....

Another thing to remember is this was a sheriff's deputy, not a cop. They only started patrolling the LIE a couple years ago (traffic stops, accidents, etc). It was not part of his duties prior to that. They should have a different mindset when patrolling as opposed to just driving. I think he should have seen a stopped vehicle on the LIE, sun or no sun.
This is true that they may have a different approach at patrolling. However, you're saying that he should have seen the stopped vehicle and i'm guessing that is exactly what he did. He did seethe vehicle and was probably focused on not hitting the vehicle so he swerved around it never expecting someone to be standing in front of him. His reflexes probably just told him to avoid the car because that is what you "expect" to see on a highway, a car. You don't expect to see a person. It's a horrible tragedy and IMO, that's what it is, a tragic accident. I feel horrible for the young man who was killed AND for the officer who has to live with this for the rest of his life. This will change him and his family forever.

I agree. He was 18, probably only driving for a year or 2 and was probably his first accident and didn't know what to do. He called his mother and said he was scared after the initial accident so he was probably nervous and wasn't sure what to do.
It's common sense to slow down when you are blinded by the sun. If it means going 5mph, then you do it. It really is a tragic story.
I agree sad sad story!! I also agree slow Down!!! You see a car stopped you would think right away better slow down!!! Especially you are in Law enforcement!!

I can't believe this is even a discussion. It is just a beyond tragic accident that unfortunately has forever scarred the lives of two families. I don't think either party is to blame...it was just several unfortunate factors that led to a very sad and tragic ending.

At this point it doesn't matter who was at fault, it was an accident. A child is dead So sad and devastating for that family and the cop that hit him.

Its a tragedy for both the family of that boy killed and the sheriff who's life will forever be changed and reminded of that. I don't think anyone is necessarily to blame. Had the sheriff or the boy take different actions maybe there would be a different outcome and I am sure the family and the sheriff will forever think about the what if's. My heart and prayers go out to them all.

As others said, I believe this is just a tragic accident.
Sometimes accidents do happen and it's not about "blaming" someone. I don't understand why there are people out there who just have to blame someone as if that will make the situation easier. I'm sure the man who hit the teenager will live with this guilt for the rest of his life as it is without people trying to point fingers and say "It's your FAULT!!"
It was a horrible accident where we all can Monday morning quarterback and say "well they should have done this or this or that", but it won't change the outcome. To me this was a terrible, terrible accident and I pray that both families can get through the pain.

While it WAS an accident, many people have said how cops are trained to drive in any circumstances (remember the tread on them driving with cell phones and a big majority of posters made a whole point to say how trained they were, etc..) SO based on those previous threads I will hold cops to a higher standard when it comes to driving. If he was blinded by the sun,he should have slowed down. That's that simple!
And yes, I have seen the cops/sheriffs on LIE. They drive extremely fast. NEVER at the speed limit!
Of course, the cop did not mean to kill the kid.
But now let's reverse the roles. A cop is standing in the HOV lane by a stranded car. A motorist hits the cop while avoiding the car. Blaming the cop should not have been there. The glare blinded him/her. Not sure we would be "as sympathetic" as in this case.
Regardless, a kid was killed and that's tragic!

It's a tragic story for everyone involved. I went to high school with the sheriff. He was the nicest guy ever. I am sure he is having such a hard time with this. I pray for both the families.

NO ONE has any facts on this case. He very well may have been going 30 mph with like the rest of the traffic, manuvered around the car, and hit the kid. You have no clue, nothing is "that simple."
It's nice to be able to point fingers, especially at those "devil cops," but it's a friggen accident. The sheriff will never be the same, his life has changed forever too...no need to rub his face in it as well...

But don't you know? Cops are superhuman. When you become a cop they hand out superpowers in the academy. Those powers allow you to shoot someone in the leg only when your life is being threatened by a knife wielding psycho path, allow you to see in blinding sun glare where other mere humans would be blind as a bat, and allow you to drive perfectly 100% of the time. You no longer are allowed to ever make a mistake or have an accident. When you become a cop you are no longer human and will be held to those standards for the rest of your career. All this to collect your pension.

In this case- I don't think any blame should be placed on either party, as I stated (or agreed with someone else who stated) earlier.
I just wanted to say, though, that I believe they (meaning law enforcement) SHOULD be held to higher standards. It's the nature of the job. Of course they make mistakes, it's human nature.
BUT-If a surgeon makes a mistake and leaves a tool in someone's body and as a result that person gets an infection and dies- you can bet that the surgeon would be a held accountable- because that's the nature of his profession.
It's not just some Joe Schmo out there driving down the road or performing surgery...KWIM? They need to be accountable, but because it was a MISTAKE they shouldn't be demonized.

It was a tragic accident - and when you play it back, the kid should have stayed in the car, the cop should have slowed down, a lot of things should have happened. Unless the cop was breaking the speed limit (not for a call), I see no reason to throw blame.
But for those posters stating that there is a minimum speed on the LIE, there is no way in hell the law is drive the minimum speed regardless of whether you can see, if there is sun glare, if there is an accident.
FTR, I do believe cops should be held to a higher standard in certain situations (not this situation). Like a cop dealing drugs, intimidating other people, should get the book + some thrown at him.
It's unfortunate that other posters in the past have talked about how it's fine for a cop to be on his cell phone because they're trained so it's ok. To me that's where the "super-human" comments come from.

It's a shame that this tragic accident happened. My heart hurts for the family of the victim who was killed. His mother will be haunted forever by her son's last words " I am scared"
This was a young boy who probably was never in a car accident. He is a new driver and was scared. Every accident I see the cars remain at the scene and people are standing outside of the car (even when waiting for police)
I am curious how many drivers drove by the boy standing outside of his car with sun glare before the cop car hit him?

Do I think this was an accident? yes, of couse. I don't think the cop meant to kill someone.
Do I think the cop could have been distracted by something? YES I would love to have his own cell phone records pulled. Maybe he was texting or on the phone. Or looking down at his in car computer. I see cops driving all the time looking at their computers. Do they have to for work, yes, I am sure they do, but it is one very dangerous practice.
I feel horrible for the family. Young kid, new driver, did not know what to do.
I would also like to know if the kid called 911 and reported the emergency before he was killed or did he just get to call his mother? If he got to call 911, I would think most cars on patrol would have been radioed about the car being stuck in the lane at that point. A timeline of events would be helpful. I would also like to know if the cop was responding to a call at that time? How fast was he moving? etc.
Horrible all around.
