Yes. According to the ME's report she didn't have diabetes, a tooth absess or any other medical condition.

Yes. According to the ME's report she didn't have diabetes, a tooth absess or any other medical condition.

Her husband is basically disputing the findings (or lack thereof in this case) of the ME's report.
ETA: I sort of feel bad for this guy (the husband) b/c there's some serious denial going on.
To go to the length of having his wife's body exhumed to perform an entirely new autopsy to prove the first one was wrong (which I don't believe was wrong) is pretty extreme.
IMO I don't think they're going to find anything to the contrary of the original report.

After the press conference the attorney said that she may have drank the alcohol to bring her blood sugar up - to self-medicate!! I feel like smacking him. As an attorney, you should never speak unless you know what you are speaking about. I actually feel bad for Daniel Schuler - someone gave him really bad advice hiring Dominic Barbara. What a tool!

Yeah, sure. The ME was wrong. They make huge mistakes like this all the time. She really had NO alcohol in her system, no pot either. He found that by mistake. But he MISSED her diabetes, her tooth abscess, the flesh eating bacteria on her leg, and the stroke she suffered that cuased her to drink, smoke and drive. Right. I know they originally tested her eyeballs b/c of fluid or something they found in there and thought it was sugar..and it turned out to be alcohol.

I definitely think she and her DH had a fight of some sort.
I'm wondering if she didn't normally drink vodka. I don't know how different alcohols effect you guys personally, but I know for myself, I have a different reaction with vodka. It takes a while for it to hit me and then it hits me like a wall, whereas with wine, I feel it immediately (usually by the 2nd sip). Maybe she didn't get a quick buzz so she kept downing more vodka and then all of a sudden she's over the edge.
*I'm not making excuses, I just keep trying to figure out why or how someone could do this. *

Had she survived the crash that killed so many and the BAC came back just as it did---NO ONE would be coming up with these health, medical, BS excuses for her.
She would be in jail.
It's not diabetes, or stroke, or pregnancy, or because it was Sunday that led to what happened.
She drank and drove. She put the bottle knowingly to her mouth and drank, not sips, gulps.
She smoked weed with children in the car--not on a Friday night in her home. In her car. On a Sunday morning, with a bottle of vodka next to her.

My husband's sister has done some crappy things to me and I find myself bringing it up in disagreements sometimes. But she didn't kill my kids.

I've totally come to this conclusion as well. She left the campsite after having a fight or something with him and then was like Eff Him and just took it too far... Again, not making excuses..

i have 2 comments:
1. greenfreak, to answer your question, the ACT of smoking marijuana is not illegal. to posess, buy, or sell marijuana is. and of course if you are smoking it and a cop sees you witha joint in your hand, that's possession. however if it's just in your systems (and there were no aggravating factors, like driving, which of course is not true in this case) then the attorney is technically correct that it's not illegal.
2. seaside - i have my own opinions about smoking marijuana, but how is smoking when you have kids any different than drinking?
i mean, if you hire a babysitter and decide to smoke marijuana, or decide to drink wine and get drunk, i don't see the difference (besides, obviously, the fact that one is illegal and the other isn't, but i don't think that is what you were referring to).

It's a fair question; here's my opinion, which is, obviously, JMO.

3. i personally don't agree with this - i would not get wasted, but if i am at a party with my kids, and either DH or i decides to be the DD, that means one of us will not drink at ALL, and someone is always responsible.
4. very true. i am not a pot smoker but i would assume that you can't smoke and not get high - whereas you CAN drink and not get buzzed/drunk.

The attorney is a distraction.
What's next? Did the McDonald's employees put grain alcohol that she couldn't taste in her soda ? Did her stash of pot make its way into the minivan's ventilation system?
I also wonder why, in her one phone call of distress, she called her brother -- two hours away -- and not her husband, who depending on the version of the story, was either fishing or was in his truck on a nearby road.
My last conspiracy theory is that her brother suspected she was drunk but didn't use the word "drunk" in his call to the state troopers. If so, could he be considered an accomplice?
