OMG! I am so sorry! That looked AWFUL! Thank God you were ok.
Nice job by the driver- no insurance or a license- lovely! You actually will be paid by the insurance company of the car that hit you and they will be paid by their uninsured motorist insurance- the BMW driver is going to get hit the worst in this situation Poor person!
But you should be ok in terms of insurance. 
I went through a similar type accident ten years ago and that is how it worked out. I was hit from behind at 60 miles an hour in stopped traffic and creamed the person in front of me. My insurance paid for the person in front of me, not the guy who hit me
