Just got laid off today....
Along with half the staff at my company
They didn't announce they were laying off staff, they just kinda did it today. Pulled us in an office, told us, watched us pack and walked us out. I've been there for 2 1/2 years, does anyone know if am I owed severance pay?

I HATE THIS ECONOMY!
I hope you find a new job soon!
I think they should pay you severance, but they are not obligated to.

Re: Just got laid off today....
if they don't want you suing them they would be smart to offer you something.
You can collect UE..but maybe you should contact HR or the Head of Administration to see if they will do something.
This is awful..I'm so sorry to hear this.

Re: Just got laid off today....
I am so sorry. Severance is not mandatory, by law. It is like a bonus for firing you (bad choice of words but no other way to put it). Not that it is even close to what you were probably making but NYS has extended UI by 33 weeks in addition to what you would ordinarily get (36 weeks).

I'm curious as to why they'd be smart to offer her something?
ETA: NY is an At Will state, they can let someone go whenever for whatever reason, correct?
To the OP I got let go in October, and had another job by 12/1 and it was the best thing that could have happened to me!

Re: Just got laid off today....
how many employees did your company have? If over 50, this lay-off may have triggered the WARN act:
From NY Dept of Labor website:
New York WARN Act Takes Effect February 1, 2009
The New York State Workers Adjustment and Retraining Notification (WARN) Act requires employers to provide 90 days’ notice prior to a plant closing, mass layoff or relocation occurring on or after February 1, 2009. Notice must be provided to affected employees and their representatives, the New York Department of Labor and the local workforce investment board at least 90 days before the event. For employers planning layoffs shortly after the new law takes effect, notice would have to be provided prior to the law’s effective date to meet the 90-day requirement. The state WARN Act applies to private employers with 50 or more workers who layoff at least 25 employees. Violations are enforceable by the Commissioner of Labor and are subject to civil penalties and back wages.
Employers planning layoffs prior to February 1 are not required to provide a state WARN notice, but are strongly encouraged to do so. Such notice will help the Department and local workforce investment boards to assist laid off workers as rapidly as possible with finding new employment. To read the law, click here.

You are correct about the at-will part.
But there are also plenty of agressive lawyers feeling the effects of the economy too, looking for cases like this.
Just because a company is at-will, doesn't mean they can't be sued for whatever. That's why most companies give severence. To avoid any further hard feelings (and possible lawsuits).
