Sorry to hear that!! I don't think they are required to give severance either- I think that's up to the company itself.

how many employees did your company have? If over 50, this lay-off may have triggered the WARN act:
From NY Dept of Labor website:
New York WARN Act Takes Effect February 1, 2009
The New York State Workers Adjustment and Retraining Notification (WARN) Act requires employers to provide 90 days’ notice prior to a plant closing, mass layoff or relocation occurring on or after February 1, 2009. Notice must be provided to affected employees and their representatives, the New York Department of Labor and the local workforce investment board at least 90 days before the event. For employers planning layoffs shortly after the new law takes effect, notice would have to be provided prior to the law’s effective date to meet the 90-day requirement. The state WARN Act applies to private employers with 50 or more workers who layoff at least 25 employees. Violations are enforceable by the Commissioner of Labor and are subject to civil penalties and back wages.
Employers planning layoffs prior to February 1 are not required to provide a state WARN notice, but are strongly encouraged to do so. Such notice will help the Department and local workforce investment boards to assist laid off workers as rapidly as possible with finding new employment.To read the law, click here.

You are correct about the at-will part.
But there are also plenty of agressive lawyers feeling the effects of the economy too, looking for cases like this.
Just because a company is at-will, doesn't mean they can't be sued for whatever. That's why most companies give severence. To avoid any further hard feelings (and possible lawsuits).

There is something else out there that I believe in.
Severence, like everything else in this world, is negotiable.
If you get laid off and a company offers you 8 weeks, demand 12. If they offer you 12 weeks, demand 16.
Even though being laid off will most likely be a "shock", you should still try to keep your head on your shoudlers and realize that this is just as much a negotiating situation as when you are interviewing.
I know if I were ever to get laid off, I wouldn't take their first severence offer. Unless my job offered me something that totally blew my socks off, I wouldn't accept it. I wouldn't sign anything in my exit interview because I would think once you sign your severence agreement at your exit interview that would more or less say you are "agreeing" to their package. I would have an attorney draft a letter to them asking for much more.
Obviously if you only worked for the company for a few years, you can't really ask for too much. But I have 10 years with my current company and counting. You damm well know I am prepared and already know what to do if this were ever happen to me.
